So this "arbitrator" is going to ignore an legally standing arbitrated list because why? LOL

If the merger happens, there are three ratified pilot contracts in force that must be negotiated into a joint agreement. Part of the proposal from the company will be an SLI method, which incidentally has nothing to do with outdated, obsolete, and inadequate TAs of the past that refer to such things as two groups and ALPA. Heck, by the time this all flushes out, who is to say that there won't be four groups merging to two, or some other unexpected combo.

Nic or not, the possible AMR+East/West combo would give all pilots at the table tremendous career expectation. This is a time for East and West to come together and focus on competing with APA to create value against DAL/UAL/SWA/JBU/EK. Hopefully management navigates the possible merger well and builds a tremendous operation—you folks deserve it.

I wonder how UAL would respond to the loss of a Star Alliance partner and Delta to stronger competition up and down the east coast. Delta's MD80s may be paid for, but AMR has some very fuel efficient aircraft on order. Delta proposes compensating with a refinery while AA will pay interest on financing? What's the better play? So many moving pieces... *sigh*

Okay - accept the Binding Seniority Award from Nicolau and the West and East can work together...

The East guys will not evade the NIC award. Before they do the SLI with the APA, the NIC award will be reinstated, probably via Judge Silver. It's just common sense, and it will prevail.

Godspeed!

I'm wondering this time around if binding arbitration will mean binding arbitration? This should be really fun to watch!! Game on!!

No, THIS TIME, they are SERIOUS!!!! And, the East guys want DOH with the APA guys, and honestly think that is possible....

The NIC and DOH are the extremes and would be too toxic to be part of a new TA. The old TA at USAir was never finished and is over five years old...

The new TA will address the here and now, which is three pilot contract groups, three FA contract groups, and two contract groups with most everyone else. Count on it, none of the negotiators are going to be looking to shove an issue to one extreme or the other. A fast ball right down the middle is the quickest way to all the payouts.

I know this will be easy for you, being a uSAPa supporter....prepare yourself for more disappointment.

So the basis is that Nic goes into effect when East/West get an agreement that they will never reach because now a new agreement will take place?

It seems to me that there is no agreed TA coming out of USAir? So......it's a pretty safe assumption that someone else would have to decide. In this case it would be going through a judge, in other words, the Nic award would be used.
Of course on the other hand, perhaps Parker is counting on the SLI issue continuing to be dragged through the courts and "his" American Airlines would continue to have payscales at the very bottom of the industry for years to come. Keeping USAPA active in the process certainly does more to keep pilot labor costs low than anything he could do.

The 9th was very clear that there are many contingencies before a contract is ratified. The AA wrinkle just proves how prescient the 9th is. USAir now wants to merge three contract groups. Who knows what their proposal will be.

I can't wait for my new shiny CRJ 900/1000... I am so happy to be a career RJ CA.

The merger will happen. Scope will be busted wide open, they will furlough thus no pilot shortage once again..

Thank you guys...

Sigh......

What if the APA and/or Parker doesn't want to take on the potential liability? Then where are the east pilots? Who do they then sue? What would their odds of making it even past dismissal be?

Welcome to the onus being on you, easties. No more 2% wrecking ball(usapa) for you.
