Ya, must be talkin about that desert judge Wake. Nice smack down from the 9th!
The 9th said a ratified JCBA would make it ripe. You ratified that agreement. That's why Silver held a trial. Just because you guys were too stupid and blinded by the promise of FINALLY a little more money and ratified the Nic. isn't anybody else's problem.
 
Let's see:
1. USAir management told the judge they accepted the Nic list and the only reason it was not implement was the lack of combined operations.
2. Management has ask the judge to give West pilots equal a place and equal standing in upcoming SLI negotiations with APA.
3.. APA will not go for DOH but will instead seek the highest seniority for their pilots.
4. The West pilots will not seek DOH but will insist that the NIC list be used for all USAir pilots as a starting point and then seek a list based on relative seniority.
5. The SLI talks will end in another arbitration where the arbitrators will consider the Nic list as an arbitrator will almost always support another arbitrator's decision (to maintain the integrity of the process and as a matter of job security).
6. The final arbitrated AA list will not be based on DOH but will be an animal unto itself.
7. APA and the West pilots will accept the arbitrated list. East pilots will once again refuse to follow the binding arbitration they agreed to and scream USAPA Forever! while being laughed at by the rest of the industry.
8. There will be a representation vote and since APA and West pilots outnumber East pilots, USAPA will be relegated to the dung heap from which it sprang.
9. Everyone in the industry will be relieved that the ********************hole called USAPA is dead and no longer embarrassing the pilot profession. We will all laugh at the former east pilots as they continue to whine "But DOH was supposed to be the gold standard. The Nic was supposed to be dead. How did this happen?"

Those who stole their upgrades will be waiting a LONG time to get them back. And those who retain them better like where they are at, because it won't be improving for them for a LONG time.

Well smart guy we had agreements as well at UAL/CO. Everything took a lot longer than the agreement stated. As a result flying only grew on the CO side and guess which side got the upgrades. Maybe your just working with three superior pilot groups and all will go like clock work. I just don't think that is based on reality.

Actually, the only reason there would be a vote is following a successful card campaign. I see zero chance of that happening especially since a large portion of Easties want APA as well.

From a consumer perspective, this is sort of like the DMV merging with the IRS. Two seperate unpleasant experiences joining forces. AA and US have always consistently ranked lowest in customer satisfaction if memory serves. You can throw all the new airplanes, paint jobs, and lie-flat seats at it you want... If you still treat your customer like sh*t, they will still notice.

You said in your original post:

As to a new contract: already have a hybrid contract of sorts that improved upon AA's. A JCBA process is set out with definitive timelines. Sure, that process could somehow be slowed down I guess but all pilots will be working under AA's contract soon.

Growth: the merger transition agreement prevents growth or shrinkage on one side only.

Lower wages: As of December 9th, every pilot (AA, east, West) is earning the same rates and the rates going forward for the next 6 years already have been decided.

Even if some timelines in the JCBA or SLI process get extended, virtually everything you said above that could happen either can't or the opposite has already occurred. Hence, I believe your predictions seem very much based in ignorance (and I mean ignorance in the nicest of ways; think: lacking any substantive information).
