With the level that the airlines have set the bar these days is negative publicity even an issue anymore?
Lets face it, when the only good publicity the airlines have gotten in years stems from a jet ditching in the river, it's a sad state for the industry.
Essentially, it's a game of chicken between counsel. Briefs are exchanged back and forth to the detriment of the clients wallet. Most get very close to trial and then settle. Trial is a HUGE expense and a big gamble in terms of a successful outcome for the defendant. Settling brings with it more known and controlled variables than does rolling the dice with a jury.
BTW, before most cases go to trial, mock trials are conducted by a common legal service where they basically engage in a courtroom like proceeding and records the outcomes of their strategies. This has a lot ot do with whether it's advisable to move forward with a trial as well.
