DHL has not violated your scope reference Kitty Hawk. Astar has violated your scope by chartering Kitty Hawk.

Now that is a good question regarding the TRO that was brought to prevent ABX from flying DHL freight before DHL took us to court, and to be perfectly honest, I do not know, (but since I haven't heard anything regarding filing one), I believe it hasn't been filed. But, glad you brought it up cause it's not a bad idea.
Maybe there's no restraining order because no need to try to shut down KHK. There's no jobs to steal at KHK. They're already out of business.
 
Another interesting tidbit on the conference call. ABX provides 2/3 of the lift for DHL in the US.

That leaves just 1/3 left for, umm, as one of the call-in analysts referred to them... AssStar

We'll see how it goes. Our view is that our scope requires the ATI &CCI pilots to be incorporated into our seniority list. It also provides for fences and seat protection. In other words, we would not be trying to take "their" flying. What ya'll :rolleyes: tried and continue to try is a bit different. I fully realize you do not wish to be confused by the facts, so there is no need to reply.

You also forgot that Hete keeps reiterating that after the CHI buyout that all companies will be run as separate entities.

Hete does still have to deal with out CBA. We still work for ABX Air. The sucessor (which still owns ABX Air), affiliate etc. are all bound to our CBA. Hete will have little choice in long run.

Wow. We thought that too. I wish you luck, but I doubt it will be as easy as you're thinking it will be.
 
And of course, Hete never has lied about anything.
I'm sure a smart guy like you knows all about corporate accountability as required by Sarbanes-Oxley. A CEO can't just spit out nonsense in a quarterly conference call.

Lying by a CEO to the investor community so his stock looks more attractive carries criminal sanctions including imprisonment. If you know Hete's lying about it, why don't you report him to the SEC!

This one should be pretty straight forward as the situation is specifically covered in our SCOPE language. If we can't win on this then I can't imagine a situation where SCOPE would be enforceable.

OMG, I just realized what you've implied there. What YOU don't realize is the difference between

1)trying to get your new partner airline on one seniority list, and
2)trying to get your new partner airline shut down with a restraining order.
 
OMG, what I just realized is that you are afraid. Joe is pissing your ACMI down the toilet and may start the transfer of abx air assets to CHI. You may eventually see a little money from it, but Joe will have dragged this thing on it court so long that you won't even exist.

I would file for single carrier status too, CHI/ATI have everything to win and you to lose. I wouldn't doubt that CHI/ATI/KHK are the survivors of everything. Joe and his minions single handedly have drug our case on longer than it should of just by asserting that 17 pilots of ROSS no longer qualified Alpa to operate under the RLA. I think they know exactly what they are doing, but you are allowed to have your assertions.
