Do you have the authority to determine what's fair? Does General Lee? Obviously we all have our own bias. That's why we use something called arbitration to decide what is a fair and equitable outcome.

We had the NIC, which the easties decided was unfair. Then we had the recent preliminary arbitration which, once again, the Easties thought was unfair. Next we will have the SLI and I'm sure the Easties won't like that result either.

I obviously don't know how it will turn out but I doubt a team of arbitrators is going to discard a product from the country's top arbitrator at the time. As Judge Silver stated an arbitrated result is strong evidence of a fair result. Thankfully USAPA won't be able to weasel their way out of this one.

Well more recent arbitrators have deviated from nic's formula.

Can you elaborate? US Airways was a dying airline. That was established in arbitration. As NIC stated all arbitrations turn on their own facts. UAL was infinitely more viable as a company than US Airways. To claim UAL furloughed pilots had little chance of imminent recall would be absurd. It was quite obvious to everyone in the industry that the 2,000 or so US Airways furloughees had little to no chance of being recalled or ever sitting in the left seat of an A330. As much as you want to change history the facts are all on record. Standby to be disappointed again.
