"As many know, up until now I have been an ardent supporter of the Merger Committee. I have gone on record as having ?Ultimate Confidence? in the committee. I helped pass resolutions giving them a degree of autonomy so as to not be influenced by any one seniority group. Over the last six months I have watched what at first was a fairly solid Protocol Agreement become watered down to a document that I believe essentially does one thing; allow a process that basically guarantees a West Merger Committee. Let me state for the record that I want all pilots at US Airways and American Airlines to be treated fairly in the seniority process. You could make a valid argument that it is hypocritical to say that APA would not treat us fairly if they solely represented us in seniority talks but USAPA could fairly represent the West in the same talks. I get it, but the Nicolau Award presents a different dynamic. Given the chance to stand before an arbitration panel as a full participant and present their case to implement the Nic, or a close substitute based on the argument that it was previously awarded by an arbitrator, is a potentially career ending chance that we cannot accept. Although we have won numerous court cases rejecting the Nic, arbitration is different and uncertain. The rules of law that apply to the decision making process of courts do not apply to arbitration. If there had not been a Nicolau Award I would have no problem with a West Merger Committee. In fact I would embrace it!"




Good stuff. So, arbitration is risky? What about the first time? You didn't know that then? Why did you agree to it and even help select Nicolau himself??

Looks like he is not in favor of this current agreement with the APA. He can see what "may" happen, and it should happen. So ironic that he states the APA could do to them what they (USAPA) did to the West. (Majority rules)

So certain industry related topics and actual problems with our industry (disregarding a binding award) are off limits? You don't want perspective new hires to know about actual disagreements? You sound like an idiot with your head in the sand. Pilots should want to know the hot topics and when other groups are treated unfairly. But, you don't want info and debate out there. Wow.

The West pilots have been "contained", stuck in PHX due to the Majority, and the rest of us apparently are ok with that? The West had been shut out of upgrades in the East, and are being pressured to accept something that goes against what they legally signed up for with the company and the Easties. It is a travesty, and people should know about it. The SWA guys aren't much better in how they treated the AT pilots too, but that is a different subject, although similar.

I can't believe your stance. Not classy. If you sign up for binding arbitration, follow through with it. It's all of our fight. The ISIS analogy is right on. It's our fight Bill. Deal with problems that can affect you, like ISIS or job wise---disregarding a binding SLI award. Not good.

No court has ever rejected the Nicolau list. They have said that it hasn't been implemented and that USAPA is free to play Russian roulette by implementing something other than the Nicolau award, but they have never rejected it, becasue it has never been presented to a court to accept or reject. The issue has always been, does a DOH list that circumvents a binding award cause a DFR by USAPA? USAPA spins in circles claiming it has no legal requirement to use the Nic, but in fact they choose to do nothing, because that is DOH.

The fact that 5000 pilots allow themselves to be extorted with the highest dues in the industry in order to preserve the "do nothing" status quo is the real travesty. They should have been forced to jump off their chosen cliff 7 years ago instead of being allowed to hide under the judges bench.

Anyone who signs on the dotted line for binding arbitration and then disagrees with the outcome is a complete hypocrite. They knew what they were signing up for and they believed the outcome would be different at the time. The inconvenient truth HURTS and I hope the new arbitration panel and APA pilots understand the implications of supporting USAPA's denial of this signed agreement - it is a bigger issue than just this seniority scramble.

Your side picked him too. You had the chance to leave him out of your choices, but you didn't. Your MEC chair actually praised him prior, saying he would do it fairly. He listened to both sides, and then asked your side to do better, to negotiate with the West because what you were stating about DOH wasn't gonna fly, literally. Sorry, your excuses mean squat. You and your side are sore losers and the next group of 3 arbitrators (the first set) will understand the West's arguments, and then it will get interesting. Why wouldn't they? Would they rule against an award from one of their own? That would undermine their own authority. What other assurances do arbitrators need these days? To look behind each parties' backs to see if they are crossing their fingers? Signing the bottom line should mean it is "binding."

I'm just glad I will have a place on the AA list someday. After multiple drug running convictions and my stack of DUI's I figured AWA was the best I could ever hope for.

And I was just slapping my brothers in Charlotte on the back saying how great it was to be at AA after wrecking so many aircraft...then we compared our up skirt pedophilia photos and arrest records before I headed out to the aircraft to waste as much fuel as possible and see how badly we could damage the company's on time performance.

Wow, being jerks while hiding our identity IS fun! Lol

It's pretty cool when a west crew tries to ******************** over an east crew by leaving a bunch of switches in the wrong place. As a 2013 hire, I had a neutral stance on the issue. Now I'm a little pissed. Someone tried to ******************** me over in the cockpit and I had nothing to do with this stuff. What a bunch of unprofessional jackass's. ON BOTH SIDES!

Regardless of part of the company you are compartmentalized into, if you find an aircraft that's been tampered with, contact your chief pilot immediately and file a report. West, East, or otherwise, if somebody compromises safety by messing with an aircraft, they should be terminated. No "if"s, no "and"s, no "but"s. That's MY stance on the issue.

Just happened to me this morning. Captain did just what you said. CP said nothing he can do. So everyone...feel free to sabotage the aircraft without consequences. This has to be an isolated incident, I would like to believe. I wish people would leave the bickering to FI, and out of the cockpit.

I'm a west pilot. My post was a joke in response to St Nic's idiotic rant.

As for intentionally sabotaging a plane i would hope that's not true. I can't imagine a professional pilot would put a plane full of pax in jeopardy over a personal vendetta. If they did I would hope they get their license pulled ASAP. Sad.
