LOA 93 is the concessionary LOA that reduced USAirways East pay rates (among other concessions). USAPA's contention was that the pay cuts expired on a certain date. Apparently the arbitrator was smart enough to see through that nonsense. It's too bad, though. Those rates snapping up could have been a big help to a lot of groups in negotiations. They just had no reasonable argument for why they should. Hopefully USAPA will finally figure out that they'll need to negotiate in good faith instead of playing these games. But I wouldn't count on it.

Only in this industry do some try to get around binding arbitration by changing unions. We shouldn't take pleasure in this loss yet it's hard not to feel there's a sense of justice in the ruling.

I agree that it would have been better for the East in that it would have lit a fire under the collective stalling asses at Team Tempe to actually engage in honest negotiations, while the West would have not benefited from that directly. Obviously, the old work rules and pay rates would be a direct win as well, and only for the East.

On the other hand, the West should have applauded a pro pilot decision in the LOA 93 case in that "it would have lit a fire under the collective stalling asses at Team Tempe to actually engage in honest negotiations." This would speed up the timeline for a final battle royal over Duty of Fair Representation and the West could have their day in court.

Either way, both parties would have had reason to celebrate. Now there is only schadenfreud.

Wrong on all accounts. Now that uSAPa lost LOA 93 and will soon lose the DJ...we will finally be able to get on with decertifying this POS union. Only then will we be able to pull in the same direction to get a contract that benefits ALL US Airways pilots.

What's put downward pressure on the industry was the East not honoring their obligations, spawning a union in the back of a van late at night in order to try and weasel out of their obligations and not negotiating in good faith to complete a JCBA when the money was already on the table. USAPA is so dysfunctional at its core, that there is little hope for a turn around for many years to come at LCC. USAPA has been a complete disaster for not only the East pilots, but the profession as a whole.

I'd be more than happy to see the east pilots lay down their swords and do the right thing immediately- not sure if they will- but redemption has to be an option- there has to be an out of some kind- make it clear and easy that the best decision is to accept Nic and get pay raises (!) Allow them the space to undig their heels
