So why settle out of court? Would a normal jury of her peers necessarily rule in her favor? I think not. Minimally, make her prove her case. I don't understand this strategy to fold like a house of cards and pay through the nose. Better to go down fighting for what you actually believe in than cave to a shyster.

Going to trial and losing looks worse (and can potentially be more expensive both in attorney fees, residual costs and a potentially large award); not to mention the negative publicity they would receive regardless of the outcome.

With the level that the airlines have set the bar these days is negative publicity even an issue anymore?

Lets face it, when the only good publicity the airlines have gotten in years stems from a jet ditching in the river, it's a sad state for the industry.

Lets face it, when the only good publicity the airlines have gotten in years stems from a jet ditching in the river, it's a sad state for the industry.

Essentially, it's a game of chicken between counsel. Briefs are exchanged back and forth to the detriment of the clients wallet. Most get very close to trial and then settle. Trial is a HUGE expense and a big gamble in terms of a successful outcome for the defendant. Settling brings with it more known and controlled variables than does rolling the dice with a jury.

BTW, before most cases go to trial, mock trials are conducted by a common legal service where they basically engage in a courtroom like proceeding and records the outcomes of their strategies. This has a lot ot do with whether it's advisable to move forward with a trial as well.

I am absolutely amazed by the attitude of so many people on here about this issue. You guys are holding a double standard and just decided to ignore the LAW. For you folks to say how SHE should feel towards porn in the CP is wrong. Those are her feelings not yours. Why not let us go back to a time when the guys were slapping the backsides of FAs with no problem. It was socially acceptable at some point as well.

This was certainly Sexual Harrassment! Doesn't matter how it was found. However, the more concerning part was the retaliation. We should all be concerned about how United responded to her complaints. If you see an issue that is important to you then complain to the company just to have those complaints dismissed you will become extremely frustrated. Then to top it off the company disciplines you at every opportunity because they are punishing you for what you believe is important. That is just wrong.

Every time I went to work...I worried about my crew, my family, my passengers and my company, in that order. I really didn't have a bunch of extra neurons left to ponder the injustice of seeing a nude male, especially after I saw myself jumping out of the shower at the hotel. Additionally, I've showered in gyms and barracks with other nude males. I don't know how I did it.

If I wanted to bum out about the injustice of the world, I pulled up my paycheck.

I understand the sentiment of your post but this lady was out for pay. Legally, we (males) could also sue. What's to prevent a man from being equally offended by the identical materials she sought to look for? Some men might opine themselves as gentlemen who refrain from such base entertainment. To find (locate) such offensive material degredates my puritan views of the female mind, body and soul. My oh my, how will I ever recover from such an engram?

Ok, under the assumption that she was out to get paid does that let UAL off of the hook by the way that they responded? I don't think that was her original motivation although after she was ignored and sanctioned her attitude may have changed.

That court case never would have gone forward if UAL had followed the law and complied with her requests opposed to doing the complete opposite.
