I think the judge sees the entirety of the case including the potential logjam. He has tried to telegraph his desire for USAPA to Wake up and settle this outside the courtroom, yet the Wake up call is never answered. He will ensure that the problem is fully resolved without additional needless trips into court, and I am confidnet his decision will reflect that.
 
So ALPA merger policy is a gamble. It is outsourced and is a complete disaster. It has to go the private arbitration, because ALPA merger policy is a joke. Just like Polar and Atlas. Another ALPA merger turd.

Its to bad AWA did not merge with Delta during their trip to BK a few years ago.

Delta had over 1500 pilots on furlough back then just like AAA, AMR or United.
ALPA merger policy would have worked great. It would have been fun to see the reaction of Delta ALPA seeing 1500 furloughed Delta pilots at the time of the merger announcement be stapled behind all AWA probation pilots. Then the list comes out a year later (and all Delta pilots have since been recalled due to all the attrition Delta had during that time), to see every single Delta pilot that was recalled get stapled behind every AWA pilot. Oh, the reaction would have been DAPA.
AWA pilots would have been furlough proof and they would be flying all those widebodies ahead of all the recalled Delta pilots hired in 2000.

Nic award can not be used if the USAIR pilots do not like it. It will be seperate ops forever or DOH with C and R.
3 things need to happen under ALPA merger policy and one did not. A joint contract , with each side having to agree. There was no timeline in getting a joint contract. East would vote every contract down that would have included the Nic. No way are you going to get more the 50% of real USAIR pilots to vote for a joint contract with the NIC. You might find 5%.

Alpa is gone now. ALPA has failed to implement the list by its own merger policy that includes a joint contract. A joint contract was impossible with the Nic award. Thats why Delta and Northwest did that ahead of the award. It could have been the same gridlock. Delta learned that it was imperative to get a joint contract. Otherwise one group could vote never to implement a list.

If you can read and understand english...like an ATP ought to, then you should be able to read the court orders issued from Judge Wake.

It's obvious that the Judge sees through all of your sides petty B.S.. The Addington case is going to remove any ability for USAPA to hide behind some procedural loophole that was never intended to be used as such. USAPA has gone all in and painted you all into a corner.

In other words, the Nicalau award will eventually BE THE SENIORITY LIST THAT YOU LIVE WITH THE REST OF YOUR CAREER AT US AIRWAYS. There is no place left to hide...you guys are simply to far outside of the law.

I suggest you start looking for another job. When the reality of Federal Law, Addington, and the DFR hit you like a speeding freight train, you're going to find life at AAA unbearable. Get out now while you still, (may) have a shred of sanity.

Oddly enough, I'm starting to feel sorry for you...

did once, the pit boss checked the cards and they watched the tapes. I was so drunk she took 3 black jacks from me, without me knowing.

Perhaps if you had any actual knowledge of the facts at the time you wouldn't be so quick to blame anybody.

Nic. knew exactly what he was doing, and the two other neutrals were in full agreement with his decision. On balance, the nic award is completely equitable to all involved.

A Federal Court is about to underscore that point.
 
USAir went from 6000 pilots in 1990 to 3500 by 2005. During this period the career progression of USAir pilots lagged the rest of the industry by a wide margin. The east pilots knew for years how far behind they were falling but the Nic. award quantified it and put it down on paper for all to see. And it looks ugly. It's very unfortunate. But the reality is by 2005 17 years' longevity at USAir got you the industry equivalent of a new-hire position. A merger with any other airline using any other arbitrator would have yielded essentially the same results.

Too bad. If you agree to a process, then you have to deal with it. The East MEC thought they were winning, and actually said in a memo to their people originally that they thought Nicelau was a good arbitrator. I hope the new judge completely rules on the while deal, and puts the USAPA krap to rest. Sorry Sully. You and Jeff Skiles will be middle of road seniority-wise at the new airline, since your airline was failing and had shrunk before being bought. And to top it off, you agreed to binding arbitration. Live and Learn.
