What strikes me as amazing is how much effort he places on trying to convince the west pilots that a finding of DFR is bad. He is clearly worried about the outcome in court. It is also funny that he assumes that all new aircraft will go to the east. There is no restriction on SK to put the aircraft on the west cert. My guess, they know they are doomed in the DFR suit so their best tactic is to be loud. I believe there is a saying among attorneys that if the law is on your side, talk on the law. If the facts are on your side talk on the facts. If neither the law or the facts are on your side talk loud. Looks like USAPA is resorting to the latter

Finally, after 12,500 posts, I agree with #12,501. I'm buying a lottery ticket.
 
I think the judge sees the entirety of the case including the potential logjam. He has tried to telegraph his desire for USAPA to Wake up and settle this outside the courtroom, yet the Wake up call is never answered. He will ensure that the problem is fully resolved without additional needless trips into court, and I am confidnet his decision will reflect that.
 
So ALPA merger policy is a gamble. It is outsourced and is a complete disaster. It has to go the private arbitration, because ALPA merger policy is a joke. Just like Polar and Atlas. Another ALPA merger turd.

Its to bad AWA did not merge with Delta during their trip to BK a few years ago.

Delta had over 1500 pilots on furlough back then just like AAA, AMR or United.
ALPA merger policy would have worked great. It would have been fun to see the reaction of Delta ALPA seeing 1500 furloughed Delta pilots at the time of the merger announcement be stapled behind all AWA probation pilots. Then the list comes out a year later (and all Delta pilots have since been recalled due to all the attrition Delta had during that time), to see every single Delta pilot that was recalled get stapled behind every AWA pilot. Oh, the reaction would have been DAPA.
AWA pilots would have been furlough proof and they would be flying all those widebodies ahead of all the recalled Delta pilots hired in 2000.

Nic award can not be used if the USAIR pilots do not like it. It will be seperate ops forever or DOH with C and R.
3 things need to happen under ALPA merger policy and one did not. A joint contract , with each side having to agree. There was no timeline in getting a joint contract. East would vote every contract down that would have included the Nic. No way are you going to get more the 50% of real USAIR pilots to vote for a joint contract with the NIC. You might find 5%.

ALPA=Nic award
Alpa is gone now. ALPA has failed to implement the list by its own merger policy that includes a joint contract. A joint contract was impossible with the Nic award. Thats why Delta and Northwest did that ahead of the award. It could have been the same gridlock. Delta learned that it was imperative to get a joint contract. Otherwise one group could vote never to implement a list.
