30-Day Cooling Off Period Begins
Polar - Atlas Merger Suspended

PURCHASE, N.Y.--(BUSINESS WIRE)--Aug. 16, 2005--Polar Air Cargo, Inc. (Polar), a subsidiary of Atlas Air Worldwide Holdings, Inc. (AAWW) (OTC: AAWW.PK - News), and the Airline Pilots Association (ALPA), the collective bargaining representative of the Crewmembers employed by Polar, were released today from negotiations by the National Mediation Board (NMB) into the 30-day cooling off period that must occur before either party can engage in economic self-help, which includes the right to strike on the part of the Polar Crewmembers. [size=-2]ADVERTISEMENT[/size]

This action by the NMB followed a decision by ALPA to reject the NMB's proffer of binding arbitration. The 30-day cooling off period is set to expire at 12:01 a.m. EDT on September 16, 2005.

"While the Company is committed to reaching an agreement, we simply can't agree to a contract that further challenges the viability of our scheduled service business," said Jeffrey H. Erickson, President and CEO of AAWW. "Unlike other carriers that have entered or threatened to enter bankruptcy, we have never asked our Crewmembers to take any kind of pay or benefit cut or make any kind of work rule concessions. Instead, we have offered a fair agreement that includes significant wage and benefit increases, which is extraordinary in the current environment."

In its effort to reach a bridge agreement pending the completion of the merger, the Company had offered an immediate 10.5% pay raise plus profit sharing, with no work rule changes to the existing contract. This offer would have put the Polar Crewmembers' contract at parity with the contract covering the Crewmembers of Atlas Air, Inc. (Atlas), also an operating subsidiary of AAWW, and the leading provider of ACMI (aircraft, crew, maintenance and insurance) freighter aircraft to major airlines around the globe. ALPA has continued to demand a 32% increase, 20% effective immediately and another 11% effective December 1.

AAWW is also immediately suspending its previously announced plans to combine the bargaining units and merge the operating certificates of Atlas and Polar. "Due to the uncertainties associated with the release into the 30-day cooling off period, the Company does not believe it is advisable to continue to pursue the merger at this time," Mr. Erickson continued. "We are, therefore, suspending the merger pending the outcome of these negotiations."

Mr. Erickson concluded by saying, "While we still want to reach an agreement and are hopeful that a labor disruption can be avoided, as a result of this development the Company will implement its contingency plans to mitigate the impact of any work stoppage."

Why would ALPA turn down arbitration? I guess they expect to get a better deal on their own.

Next weeks class has been cancelled, probably done hiring until next year after all this is worked out. At least that is the word around.

Don't forget, this press release is WRITTEN by Polar Management and released on www.atlasair.com.

The part about 10.5% pay bringing Polar to parity with Atlas is a straight-up lie. You can do the math yourself looking on airlinepilotpay.com. It would take over 23% pay increase to bring the Polar group up to the Atlas pay.

It's going to get ugly.

Sept class was it for the year anyhow, that has been the plan for a couple of months now according to HR due to the busy season coming up. I was told that they expected a class in Sept. but that it had not been confirmed, August was the last for sure class anyhow. Plus they are way behind on getting the IOE's done from what I hear, Lost of guys sitting waiting for a check airman to free up. Some are in their second month of sitting at home getting paid while waiting for a slot, so there is a good chance that hiring was going to stop until they caught up anyhow.

If it gets the pilots a better contract with higher pay without bankrupting the company, then yes -- it will be a victory for ALPA.
 
Does anyone know if this affects Atlas classes this year?

Alaska Airlines is the example of what arbitration can do to you in this current environment.

I couldn't agree with you more. As long as the company keeps this up the game of "Chicken" will continue.
 
Nice to see a pilot group with some cajones. I hope to be a part of that someday.

If things go the way the posturing is, PO will not be doing much hiring. Potential layoffs and planes to Atlas. Until there is one pilot group, management will keep playing one off the other.
 
Atlas Mangement is in the process today of notifying probationary crew members in the Polar side that they are FIRED. Atlas management is using this strategy during the 30 day cooling off period to strike fear into the pilot group.

There are about 50+ pilots at Polar that are still on probabtion, and they are all being fired as of today....just because they can.

Gotta love this biz.
 
Seems like a poor move on the company's part!

If you fire 50 guy's which are on probation. Most likely the majority of those guys would not return. At least I wouldn't. The cost would be astounding to the company when negotiations were completed. You would not face only the cost of retraining "X" amount of crews, but you would struggle to recover the lost revenue while the needed crews came up to speed. And I guarentee that the senior guys would not be bought by overtime after such tactics against there fellow pilots had been taken. Just my thoughts.. Sounds like you guys have a fairly cohesive group. I truly wish you all the best!! These things tend to get pretty messy before they begin to turn. Again, good luck!

I heard a rumor of this last week, but after speaking to a friend of mine today at Polar (who is not on probation) he made no mention of this threat materializing.

Can anyone confirm?
 
A friend at Polar was "fired" today. He has been there about 6 months and was told to expect an Atlas class in a few weeks. Seems they are trying to get a "short course" (a week or so) approved by the FAA.

Also.....it appears that he will be placed on the BOTTOM of the seniority list for now as the merger is on hold. Hopefully, when it's all over and the merger is back on, the negotiations will provide these guys with some restitution....in the form of seniority.

Just when you think you've seen it all.

But come on does it surprise anyone?! R U Kiddin?!

Here's the deal the Polar fleet will be reduced from 12 to 9 over the next few weeks. Which means furloughs and downgrades at Polar in both fleet types effective immediately. Mgmt says we been takin it in the poop shoot on scheduled service due to the rising price of fuel (Usually these guys play loose and fast with the truth, but this I believe). ACMI can shield a company from some market flux with fuel. Polar is the scheduled side of the house so those planes are being returned to Atlas with one 200 being sold.

Polar cats have been up in arms and really vocal about their position (oh the much coveted China route authority. its authority boys they aint gotta operate those routes), but the situation is totally not in their favor. Carrier in a carrier operations always weaken the negotiating position of the labor force. And Atlas has been hiring full bore.

Guys pay attention Mgmt ain't stupid they plan this S$#t. This isn't europe where unions still matter. Look at NWA AMFA they are gonna get layed off or fired strike or no stike its a done deal. It sux but these are the realties that we live with. Labor law in this country has been Evicerated and continues to be so (we know by whom too!)

I feel really bad for my friends at Polar and I have friends there. This will get worse before it gets better

Looks like we dodged a bullet on that one. Wow just when you think management can't get any $hittier, another management team comes along and trumps them. Hopefully every one of those 50 guys leave and hose that whole operation. People that pull that kind of thing should be behind bars.
 
So far only the 400 drivers have been fired, no calls to the classic crews yet......yet. Probably coming tomorrow.

Looks like it will come down to the Atlas MEC and if they support the Polar side.....which they should since their contract is up in January and they have to fight this very same fight next year. If they do not, I am sure the company will do the very same thing to them and transfer flying away from their crews and start the mass firings.

Interesting times.....getting the popcorn out to watch.


It does set a new low for managment types for sure.
 
Yikes... So how many people is that? 50?
