Judge rules Mesa destroyed evidence
Thursday September 27, 11:42 pm ET

Mesa Air Group intentionally destroyed evidence that could have been used by Hawaiian Airlines in the lawsuit against its competitor, a federal bankruptcy judge ruled Thursday.
U.S. Bankruptcy Judge Robert Faris also found that Mesa executives made their decision to start a cut-rate interisland airline in 2006 based on information they got while looking at Hawaiian's books.

Mesa reviewed Hawaiian's finances in 2004 while considering investing in the airline.

Hawaiian (Amex: HA - News) is seeking at least $173 million in damages from Mesa and an injunction that would block Mesa's interisland carrier, go!, from operating in Hawaii for a year.

Faris made the ruling on evidence that may be used at the trial on Hawaiian's lawsuit, which is scheduled to start Friday.

On Wednesday, Jonathan Ornstein, CEO of Mesa Air Group, testified that his company started go! because he thought he could make money, not to drive either Hawaiian Airlines or Aloha Airlines out of business.

Because of his lower costs and smaller planes, Ornstein said Mesa could make a profit offering fares between $40 and $50, roughly $35 a ticket less than what Aloha and Hawaiian were charging.

In court, Ornstein reiterated what he has said publicly: he had no interest in putting either carrier out of business, only in competing for interisland passengers.

Ornstein also said he had trouble believing allegations by Hawaiian that his CFO, Peter Murnane, had purposely deleted computer files that contained potentially incriminating information. Last Friday, Mesa placed Murnane on administrative leave while Mesa investigates the allegations that he purposely erased files.

Earlier this week, Mesa said Murnane was trying to hide his visits to sex-oriented Web sites when he erased data from three computers.

We're laughing here, I guarantee they're laughing in court as well. If this excuse is the best they can come up with for missing data, Mesa is going to get screwed.

The porn viewer in question, however, knows where all the skeletons at Mesa are. You can be sure that for taking this bullet he will be WELL compensated. Probably the most revolting thing about this whole sorry mess is that he'll be living on a beachfront property with millions in the bank.

there's still a chance he has to wait a little while on that beach house. the destruction of evidence will likely be turned over to the DA for review. if they see fit they may pursue a criminal trial against PM.

i'm not holding my breath, but i am crossing my fingers. :)

i really like the new aloha ad, classy and folksy at the same time... no voice overs... just a montage of friends and neighbors who are ALOHA...

a head-bean-counter of a very evil airline getting fired is a great thing. What a piece of ********************.

Sucks enough to work at that company, now add an even more embarassing management team to the long list.
