Judge OKs Hawaiian reorganization plan

Hawaiian Airlines said it will emerge from bankruptcy protection on June 1 after a federal judge approved the airline's reorganization plan yesterday.

U.S. Bankruptcy Judge Robert Faris issued a 26-page order finalizing the plan which will place Hawaiian under the control of San Diego-based Ranch Capital LLC and allow the airline to begin paying off its creditors.

"This was the last hurdle for Hawaiian to exit bankruptcy," said Joshua Gotbaum, Hawaiian's bankruptcy trustee.

"We now have the court's endorsement of our reorganization plan. Hawaiian will exit bankruptcy on June 1 a stronger, better airline."

Gotbaum said Hawaiian's president and chief operating officer, Mark Dunkerley, will become the company's new chief executive and president starting June 1.

The airline, which filed for Chapter 11 reorganization in March 2003, will begin paying its creditors once it emerges from bankruptcy. The airline said it owes about $246 million to about 1,100 creditors.

Gotbaum said that Hawaiian's reorganization is unusual because its creditors will receive the entire amounts of their claims, mostly in cash. In most bankruptcies, creditors receive pennies on the dollar.

Gotbaum said that existing shareholders will get to keep their shares, which have risen in value during the bankruptcy ordeal. He also noted that the airline's unionized employees have new contracts, in which their salaries and benefits are comparable to or better than those offered by Hawaiian's competitors.

Gotbaum added that the airline is looking to lease additional aircraft to fly new routes. Yesterday, the airline announced that it will begin daily, nonstop flights to San Jose, Calif., starting Oct. 1.

Ranch Capital will emerge as the airline's controlling shareholder. Last June, the company paid $41.4 million to acquire 10 million of the 28.4 million outstanding shares of Hawaiian Airline's parent, Hawaiian Holdings Inc.

The approval of the reorganization plan came after the airline's pilot union voted to ratify a new contract earlier this month. The pilot's union was the last of the company's six unions to approve a new agreement. Ranch Capital required each of the airline's six unions to renegotiate their contracts as part of the reorganization. The pilot's union voted down a tentative contract in April but approved a later version after Judge Faris warned that he was prepared to impose a new contract if both sides failed to reach agreement.

For all the furloughees out there-As soon as they sign leases for these A/c expect recall letters to go out.

The problem is that they are cancelling flights 3 and 4 in order to start this new service. I certainly hope they know what they are doing, because from what I have heard, all of the LA flights are pretty full. This is not expansion, it is lateral movement. As for the new aircraft, I hope they do acquire new aircraft, but until they are painted purple, and parked on the ramp, I'm not getting my hopes up.

Talked to our FAA guy and he said that we are actively bidding right now on avialiable 767's. He also told me that they were outbid just recently by another company on 1 767.
The cancelled flights are in case they cannot find A/C-which is highly doubtful-with all the downsizing the mainland carriers are doing.
Hope that helps.

I'm out!!

They can 'bid' all they want. 767's are rare on the used market right now according to a friend at Boeing, and those that are available are 20 year old dogs.

Has management hinted at all about putting in an order for more new ones? I know Boeing is begging for 767 orders to keep the line going. It wouldn't take long at all to get some straight from the factory.

Wasn't in ingenious for Adams to turn in those 767's. What a great strategical move. Man, everyone used to b!tch and moan about the LTU planes, and they weren't even bad. Wait till we get a bunch of 20 year old planes that have been beaten up by European non-sched's. I hope that we can find some decent planes, but I hear the same thing as HAL. The company I am currently working for flys 757's (old beaten up one's) and have been looking to start a 767 program. However, they claim that the only planes on the market are so bad that they don't even want them. Well, I guess hope for the best, and prepare for the worst is all us furloughed guys can do. Can't wait to see Gottbaum finally leave though.

Cool deal guys! Pualani can fly free and the rebuilding can begin. Bring back the furlough guys ASAP! :D

Hey Erndogg, You Da Man Cuzz! :D

Congrats you guys!

Way to go you guys...Man, I hope we join you soon. Press your union and fight management to keep your contract strong. I wanna use you guys as comparables when the time comes! Way to go!

Not sure I want to wait until 2010 for a recall for the 787.

Same deal on used 757's too according to Boeing, and that production line was just shut down so you can't get new ones. Bad timing I guess.
