Article on CNN today about this guy. He served 13 years in the Army as a helicopter pilot.

WASHINGTON (CNN) -- For Erich Scherfen, being on a government terror watch list isn't just a matter of inconvenience. It could end his career.

Scherfen served in the U.S. military for 13 years, as an Army infantryman in the first Gulf War and then as a helicopter pilot in the National Guard. After receiving an honorable discharge, he was hired as a pilot by Colgan Air Inc., a regional airline operating in the Northeast and Texas.
In April, Colgan informed Scherfen that he was on a government list and would be suspended from his job. He was told he faced termination on September 1 unless he was able to clear his name.
But Scherfen, of Schuylkill Haven, Pennsylvania, has been unable to do so and said fears it could mean he has no future as a pilot.
"My entire career depends on me getting off this list," he told CNN. "I probably won't be able to get a job anywhere else in the world having this mark that I'm on this list."
Witold Walczak, an American Civil Liberties Union attorney representing Scherfen and his wife in a lawsuit, calls the government actions "unfair" and "unjust."
"It is quite clear when the government does something that takes away not just your job, but your occupation, your career, they have to provide you with some means to clear your name," Walczak said.


The lawsuit, filed this week in federal court in Pennsylvania, asks the U.S. government to remove Scherfen and his wife, Rubina Tareen, from any watch lists or databases that inhibit their travel.
Scherfen is a convert to Islam. His wife emigrated from Pakistan when she was 17 and is now a U.S. citizen. She runs a small business selling books and DVDs about Islam, publications she describes as nonpolitical.
Scherfen and Tareen have both been stopped when traveling and told by security personnel that they are on "a list." Scherfen calls it "embarrassing."
Tareen said she thinks they may be on a watch list because of their Muslim faith and her Pakistani heritage. The two said they are not terrorists and don't associate with people who are.
"I have no idea why I am on the list, and they're not telling officially that I'm even on the list," Scherfen said. iReport.com: Are you on the list?
In a statement, the U.S. Justice Department said it will not confirm or deny that the couple's names are on a watch list for national security and privacy reasons.
In May, Scherfen and his wife wrote to the Department of Homeland Security asking for help with their case. The department referred them to the Transportation Security Administration's Traveler Redress Inquiry Program. This week they received a number to track their case, but their complaint has not been addressed.
A TSA spokeswoman told CNN the agency is seeking "a meaningful resolution" to the couple's case but said there is no timetable for doing so.
Meanwhile, a federal judge has the case under review. He asked that Colgan move Scherfen's termination date to October 1. The airline has done so, allowing more time for a possible resolution.
"Unfortunately, it is a problem that is shared by countless individuals who have no connection to terrorism, have no connection to crime and don't belong on this list," said Walczak, the ACLU lawyer.
Walczak acknowledged the need for the government to protect the country from threats with a watch list but said, "The problem with what the government is doing is that they really don't care about innocent casualties."



Scherfen said the pain of his situation is accentuated by the fact that he spent 13 years in uniform protecting the country.
"We served honorably," he said. "We served in a war. And they're thumbing their noses at us, basically, and that makes me feel ... really sad about this situation."

I know of at least two other pilots that are currently flying that are very likely to be on the no fly list.

I contacted some PR lady at Colgan named Mary and she told me it was the law that he should not be allowed to fly. When I confronted her with the truth - that it is not the law and that there is no way to know for sure if he is even on the list, she then got defensive. I asked a few more question and she told me she didn't like my tone. After the call ended she calls me back and threatens me; asking me who I was and that she was going to get their attorney etc etc.....It was pretty good comedy except for the fact they are messing with some guy simply because he is muslim and they think he is on some list.

Why is Colgan not letting this guy fly anyway????? Is the owner some sort of anti-symetic.

Any of you colgan boys and girls know?????

The TSA/DHS/etc. are a joke...and need to be disbanded. Let them screen baggage, let them screen pax, and get them the hell out of policy and law enforcement issues.

Wow, just wow. TSA can go f$%k itself in every hole it has. And it has LOTS of loopholes.

A part of me feels bad for this guy. But in todays world, if you marry a girl from Pakistan and convert to Islam, you're just asking for trouble! Especially if you are an airline pilot. Keep this guy on the ground until we know for sure what the deal is.

I think they should keep you on the ground......Do you know how many people convert to the religion of the person that they marry? Lots. Makes it easy to raise a child etc. Why don't you back away from the Fox news and read a book or real newspaper.

It is a good thing Max Powers isn't working for Homeland Security. Yeah great idea let this guy keep flying and when we puts his Saab in to the Empire State Building we'll just say, "Oh sorry about that we knew something was funny about this guy but we didn't have enough to charge him, so we let him keep flying." Real smart. :rolleyes:

If they grounded every pilot that practiced Isam then yes I would agree that it is bullsh1t. But they're not. They obviously have enough dirt on this guy that they think he is better off on the gound. I'm sure that there are other pilots that practice Isam in this country that are not on the list.
 
If they have "dirt" on the guy, then they need to present it in a court of law for a verdict to be rendered by a jury of his peers. Dubya is not above the Constitution.

Since he is the one taking the government to court to get his name off the list, then HE needs to prove his case. He isn't being charged with anything, like you said, HE is charging the government with something and now the burden of proof is for him to prove that he was wrongfully put on the list. The only way to do that would be to prove why he isn't a terrorist. This time the government is "INNOCENT UNTIL PROVEN GUILTY".

Are you kidding? The government put HIM on the list. And for what reason? Do they have proof that he might be a terrorist? Does he associate with known Al Queda members? He shouldn't have to prove anything unless they have evidence that links him, without a doubt, with terrorists. How is he supposed to defend his name if he doesn't know why he's on the list. Shouldn't the governement bring for evidence or reasons as to why they put him on the list.

Last time I checked I still lived in America. The bill of rights gives EVERYBODY freedom of religion. The thing that scares me the most is that this could happen to anyone. How would you feel if you somehow get put on the list, without any just cause? The system is horribly flawed. If a 11 year old can be put on the list, anybody can be put on the list.

Like others have said, innocent until proven guilty.

Um, ok? So that is criteria enough to put someone on the no fly list? So much for the first amendment.


What a huge slap in the face to a fellow war veteran, who fought and served hard for this country! How dare the TSA put him on a no fly list, considering he's flown Apaches to defend America?

TSA = Totally Stupid A**holes
