Prolonged exposure to solvents such as acetone, toluene and paint thinner can cause one to register way too high on a breathalyzer. Many a car painter has used this as defense in DUI trial by jury and won.



Sooooo ..... If I'm hearing this right. Time to start huffing paint thinner ?

(a) No person may act or attempt to act as a crewmember of a civil aircraft

(1) Within 8 hours after the consumption of any alcoholic beverage;

(2) While under the influence of alcohol;

(3) While using any drug that affects the person's faculties in any way contrary to safety; or

(4) While having an alcohol concentration of 0.04 or greater in a blood or breath specimen. Alcohol concentration means grams of alcohol per deciliter of blood or grams of alcohol per 210 liters of breath.

If it's not a testing error then,

Either the guy drank a couple of drinks in under 8 hours prior, or drank a lot more than 8 hours prior and still had .05 in his system in which case the hangover itself would "affect the person's faculties." You don't have to have any alcohol in your system to be found compromising safety due to a hangover.

Yep. You can have the worst hangover the next day and blow 0.0. To further that, if true, no doubt that he wasn't fully rested. What if your family was on board? Would you be like Waveflyer and say "Well, there has never been an accident attributed to a pilot being drunk, so let's give the guy a break."???

Lets stop making excuses for behaviour that we should have zero tolerance for, good job on behalf of the agent that stopped this idiot before he put his passengers at risk
 
Hey Jackwagons! I know this flight info., but wait for the facts before tossing the bombs. Just heard about another pilot accused by the TSA of drinking, supposedly blew .025, upon further review the machine was offf, actual BAL was .000.
