WASHINGTON (Reuters) - American Airlines (AAMRQA.UL), US Airways (LCC) and the U.S. Justice Department said on Wednesday they were open to settling a court fight over whether the two companies should be allowed to merge, but there was no sign of an imminent agreement.
The Justice Department filed a lawsuit in mid-August, asking a federal court to block the deal, which would form the world's biggest air carrier. The government said the merger would lead to higher prices for customers, while the companies said it would make them more competitive and strengthen the market.
In a document filed jointly by the Justice Department and the two companies on Wednesday, the government said it was "open to a settlement that addresses the anticompetitive harms posed by the merger but have not yet received any such proposal from the defendants."
In its initial complaint, the department focused on Ronald Reagan National Airport, outside Washington, D.C., where the two companies own a combined 69 percent of takeoff and landing slots. It also listed more than 1,000 city pairs where the two airlines dominate the market.
The two airlines said in the joint filing with the district court in Washington, D.C., that they had tried to settle the case before the complaint was filed "and continue to believe there ought to be a realistic possibility of settlement."
Two sources told Reuters earlier this week that there had been little or nothing in the way of settlement discussions before the complaint was filed. A person familiar with the matter said that the companies had offered concessions to the Justice Department but declined to describe them.
The two sides have been at loggerheads over a trial date. The Justice Department initially asked for a February trial and then amended that to March. The airlines asked for a November trial.
The airlines complained about the proposed delay in a second filing on Wednesday in which they said that the Justice Department's proposed schedule would "place the merger at risk regardless of its competitive benefits."
In the joint filing on Wednesday, the two sides asked the judge to resolve the dispute at an initial scheduling conference set for Friday.
Companies generally push for expedited trials in merger challenges. Holding a deal together for months puts a strain on the parties because they are essentially in limbo, unable to merge and hampered in making independent long-range plans.
The case at the U.S. District Court for the District of Columbia is No. 1:13-cv-012346-CKK.

This will be easy. AA will divest of MIA and ORD hubs, and US will dump CLT, PHL, and DCA. That will make it number 4 for sure! Go getum Dougie!

Not even close...funny stuff. Maybe the current WH DOJ staff will have an opening soon on their anti-trust team. A settlement will happen within months unless egos, once again, get in the way. A 14 Billion dollar train is nearly impossible to derail. We will know more soon. The current WH admin clowns - Holder, Baer et alia, haven't a clue what they are doing and threw a hail mary 2 days prior to the merger close and are now squirming and sniveling like little children. Having read all of the lawsuit papers filed, it is a surprise that any of what the DOJ is trying to get to stick is entertained by any sane judge. There is no precidence, standing and is mostly frivolous. Entertaining - yes. In good faith - not even close.

Also, the AFL-CIO threw their weight behind the labor groups of both companies this week as well. Funny, last week Baer was mister tough guy, then his bosses boss gets a call from his biggest group of influence and handlers, and this week Baer is now mister delay.....okay we can settle.

The DOJ apparently is unaware of the effect of internet ticket distribution has had on competitiveness in the airline industry. Airline seats are commodities, like milk. The DOJ is making all this noise so that the traveling public can still choose the color of the cap on the top of the milk jug. They do nothing about the cheesy lumps that come out when you pour.

I don't have a dog in this fight, but IMHO this has something to do with DCA slots. And somewhere there is an airline with strong Washington ties that is pulling some strings to get what it wants.

I think you're right. DOJ is hoping the AA/US figure out which airline it wants to see benefit before they actually have to go to a courtroom.

It must be Southwest, they can have the slots in DC and offer lower cost tickets to the public ;-)

SW have strong ties everywhere.

Plus, they might even get the Phoenix operation as a bonus
 
^^^^^I am curious why people assume that PHX is on the chopping block? I get that it is not the greatest idea to launch Asia/Europe flights from, but what else. Is US Airways going to close PHX if the merger goes through and not replace the flying? The way I see it, LAX is maxed out for flying as it is. So are they going to use DFW....another city could not support the total flying lost with a PHX closing. I can see a draw down, but shut down. They will cut routes that compete but are not profitable. So if PHX to wherever is better than LAX to wherever, why cut the PHX. Ever been to PHX at 900pm. It is like ORD. Tons of flights, tons of PAX. LAX can not fully support the West Coast and Mexico flying Phoenix does. Neither can DFW. So why do a lot of people think PHX is the most likely to get axed. Last I checked, US Airways competes well against SWA there. So you would not want a SWA "monopoly" there right.....just would like to know why people think PHX is so useless to the newAA.
