In accord with the foregoing and the entire record in this action, it is
hereby ordered that Defendant USAPA and its officers, committees,
representatives, and agents shall immediately, and in good faith, make all
reasonable efforts to negotiate and implement a single collective bargaining
agreement with US Airways that will implement the Nicolau Award seniority
proposal unmodified, according to its terms. Defendant USAPA and its
officers, committees, representatives, and agents shall immediately, and in
good faith, make all reasonable efforts to support and defend the seniority
rights provided by or arising from the Nicolau Award in negotiations with US
Airways. Defendant USAPA shall not negotiate for separate collective
bargaining agreements for the separate pilot groups, but shall rather negotiate
for a single collective bargaining agreement that incorporates the Nicolau
Award.
The Court retains jurisdiction to modify or dissolve this order upon
motion of any party.
IT IS THEREFORE ORDERED that counsel for both parties may submit any
comments and objections relating to the Court’s proposed injunction language on or before
June 30, 2009.

DATED this 25th day of June, 2009.

Good for the His Honor. I guess when you agree to arbitration, you agree to adhere to the arbitrator's decision.

That seems to have escaped the pickleballers.

Guess you've never seen contract negotiations before. If a TA is voted down the parties return to negotiations and try again. And you get to enjoy LOA93 a while longer.

If it has a substantial raise for the East it will past. NIC is the list. It will never be changed.

Woo Hoo!!! I knew that justice would prevail. It's all about fairness and respect, something that the USAPA leaders have forgotten somewhere along the way.

So to any USAPA supporters here: Focus on what is really important!! Get a good contract, then everything else will work itself out.

Nothing. Just be aware that unless you're willing to work under LOA 93 for the next 35+ years, the Nic. is the seniority list. Good Luck spinning this ******************************.
 
The west keeps throwing loa 93 out there like it's a slap in the face. Yes it sucks but what you guys don't realize is the majority on the east have adjusted to the pay(execpt 190 guys and that wasn't from loa93 ). I've been asked from the jumpseat what it's gonna cost for a yes vote including the nic. Keep this number in mind - $40-50 pay raise for fo's. That's my price,and sure many other fo's out there, otherwise I'm sure they will be fine under loa 93, and also don't forgetany guys have secondary inces etc. Where us is thier secondary paycheck. So do the Capra that want a ten dollar raise outnumber those fo's that will never see the left seat?

You presume that all future growth and upgrades is East. Wouldn't it be fun to watch if Parker grew the West and your deliberate seperate ops bites you in the tuchus. I don't know what the future holds but I'll bet a policy of 'seperate ops forever' will ultimately hurt you more than it helps.

And BTW, those old FO's who will never upgrade under the Nicolau list would never have upgraded under the 2005 seniority list either. Nicolau merely maintained their career expectations as ALPA Merger Policy directed.
