The city settled out of court with the family of Monfils. They weren't supposed to release his name, but there was nothing in writing specifically prohibiting it at the time. The procedures have changed at the police department.

If at some future date your information becomes available to the FAA, you'll have your certificates revoked...all of them, for fraud. Conversely, if you have legitimate evidence that your condition has been handled and has two years probation without evidence of reoccurance, then you should have little trouble presenting this to the FAA.

I wouldn't merely put it on the form and hope for the best, however, You should, at the least, consult with professionals who deal with your specific question. You're far and away best being fully open and disclosing anything that might come back to haunt you later. Don't let it hang on the idea that merely because you don't tell the FAA, they won't find out. Someone who wants a favor from you, someone who does an indepth background check on you, someone that wants to blackmail you, can easily use small things like this against you, holding it over your head...and though in all liklihood that will never happen, you'll always know. It will bother you.

Be open, disclose your condition under the guidance of a professional, consult in advance with an AME (such as the professional who will be counseling you), and make your decisions and acts based on solid counsel...not what's found here on this site. A little thing like this, wrongly handled, can be a career breaker. Don't let that happen.

I'm curious as to know how the FAA could find out an unreported medical problem than you consulted a doctor with other than if you had an aircraft accident or other unrelated violation. Recently I read this article at avweb.com and it gave a survey and something like 1/3 of all pilots didn't report a med problem to the FAA and another 21% didn't report medication. Since medical records are so sacred and strictly confidental the only circumstance in which I can envision anyone getting a hold of them is with a suponea or other court order. This seems difficult to do even when it relates to a criminal investigation (minors having abortions when statuatory rape is likely) let alone an administrative certificate action. On the other hand the FAA can (and does) have complete access to the National Driver Register to check for motor vehicle violations and other misdemeanors and felonies. I, personally would be honest about whatever condition I had but that is just my 2 cents. I would find it very surprising if anyone could find out whatever condition you had unless you happen to tell people other than your personal doctor or had a recurrence of the condition that people could see.
