Because the merger agreement said the list would not be implemented until after a joint contract and USAPA decided they'd rather have years of ********************ty pay and never negotiated meaningfully for a new contract.

Everybody in the industry realizes what a bunch of pitiful, unethical aholes that USAPA and the east pilots are. They get zero respect outside of the false respect they give themselves. The day USAPA and the BS they stand for dies will be will be a great day for the pilot profession.
 
No, I just didn't understand the rhetoric. It's weird to me that the US Airways guys won't be represented at the arbitrator's table (if that is the case) and that the Nic award would get used.

What started this whole question in my mind was the fact that the Cactus pilots think they are going to have a seat at the table, which is weird too.
I agree, the west should not have separate representation. USAPA has extorted thousands from west pilot in the form of the highest dues in the industry while providing absolutely no service. They should be forced to represent the west (finally) and either deliver the Nic or face the consequences that Silver and Wake alluded to. Either way the Nic is used.

APA, the courts, the west, Parker, Mormons, the UN, everyone knows that USAPA will try to derail and delay and the legitimate seniority integration and the only way to avoid being held hostage to their little games is to cut them out of the picture. An MOU is not a contract and it is APAs best interest to secure a real contract and establish itself as the single bargaining agent as soon as possible.

The US pilots had the capability to put in real labor leaders (and not necessarily a re-run of ALPA) and oust the painfully stupid USAPA crew, but they were too timid and the east fell for the lies and threats.

USAPA abdicated their responsibility to put a Nic-inclusive contract to a vote because they knew it would pass. If it hadn't it would have been the strongest argument possible that they were in fact fairly representing the west.

Wrong. The MOU was seniority NEUTRAL. Despite the fact uskkabba claimed otherwise after the vote. They have a habit of being hypocrits depending on the situation. Wait until you see the results of the AAL SLI. you'll be holding that nic affirming doc you're so anxiously awaiting.

Marty, Ferggie, an Koontz filed a lawsuit on you behalf that claimed USAPA abandoned the Nic. The judge agreed with you that they did.

You better read silvers ruling again. She reaffirmed that the Nic was "powerful evidence of a fair result" and that USAPA was on dangerous ground for not using it. The problem is USAPA never has been able to move an in untoward an integrated list because they've been ignored by the company since birth. It's been a Mexican standoff for 6 years. That's about to change. Nic, it's relevance, or it's "powerful evidence of a fair result" haven't gone anywhere. It's going in front of the next arbitration panel as well. Why is USAPA screaming bloody murder that they're being kicked out of the sli? One reason. THE NICOLAU AWARD. If it's irrelevant, why the hysteria?
