Not that their is a snowball's chance in hell of it happening, but, for the sake of argument, if USAPA was elected the union for the new AAL, what do you think APA would be doing right now?

Did APA, in fact, try to change the language of what was agreed upon previously as to who would represent each group? Is that even what happened? Both groups put out emails pointing fingers at the other group.

No, and if USAPA is to believed APA announced their intention to change the MOU language in agreement with the company. USAPA believes those changes will be detrimental to US Airways pilots. Personally I think they are pissing in the wind, but I understand why they fight.
 
USAPA should have had the foresight to realize they may need credibility in the future and conducted themselves accordingly. But we are dealing with a group that bragged about not needing a "plan B".
 
For those that are on the inside, what happens if and when the NMB grants the American Pilots Association representational authority over all US Airways pilots and the arbitration hasn't happened yet? That is going to happen, no matter what. Arbitration cannot happen until the JCBA is done. uSAPa will be long gone before then.

It looks like Judge Silver said that USAPA can't have anything to do with seniority battling when they no longer represent the US Airways pilots, so how does arbitration under Bond-Macaskill work? Does the APA sit on both sides of the table? Who represents the interests of the US Airways guys? Yep. The APA will assign committees.

This is a weird situation, it will probably work out fine if the NMB doesn't rule until after arbitration is done, but what if it does? Anyone have any insight? It will work out great as long as uSAPa is not involved in the process.

APA is a collection of fools! They will can't have it both ways and USAPA just filed a lawsuit in DC to block them from there revenge streak against the US Airways pilots. The west better get on board with THERE union and stop the APA monster before it kills them. The west brings nothing to the table and can easily be cut out of the system.
The NMB WILL NOT give the APA the key that they want to screw the US pilots. They screwed TWA with a staple but that won't happen again.

No, APA will have every right to choose the SLI under their watch as sole CBA. They will likely cede that power to an arbitrator and submit their list and the Nicolau list to an arbitration panel, just to keep their hands clean.

They really can't submit 3 lists because the HP/US arbitration was already done and APA doesn't want to open a can of worms about which USAPA has already been warned by numerous courts.

An arbitration panel will hand down their ruling and it will be implemented followed by a new contract (not a joint contract) negotiated by the APA.

USAPA may try to block any or all of this, but there is no court who hasn't already seen through their phony union window dressing. With the support of the AWA pilots, APA will do what USAPA was too impotent to do and the east pilots will be marginalized until the entire pilot group becomes homogenized in about 5-10 years.

Slap-flighting aside, seriously, what happens in an arbitration? Does APA hire lawyers and consultants for both sides of the table? I imagine some discussion of this has already taken place. For sake of argument, pretend the NMB gave APA full representational authority. Then how does the arbitration work?


According to MB. It's a statute, therefore the NMB can't summarily disregard it.

You ratified an MOU that specified the SLI would be CONSISTENT with MB...not exactly MB itself. The NMB could care less about SLI. It's all addressed in the MOU YOU AGREED TO. The APA know how to be a union, USTUPID does not. I'm not at all worried about the APA. As long as uskkabba dies a quick painful death, I'm happy.
