No, APA will have every right to choose the SLI under their watch as sole CBA. They will likely cede that power to an arbitrator and submit their list and the Nicolau list to an arbitration panel, just to keep their hands clean.
They really can't submit 3 lists because the HP/US arbitration was already done and APA doesn't want to open a can of worms about which USAPA has already been warned by numerous courts.
An arbitration panel will hand down their ruling and it will be implemented followed by a new contract (not a joint contract) negotiated by the APA.
USAPA may try to block any or all of this, but there is no court who hasn't already seen through their phony union window dressing. With the support of the AWA pilots, APA will do what USAPA was too impotent to do and the east pilots will be marginalized until the entire pilot group becomes homogenized in about 5-10 years.
