Question for those in the know: USAPA is no longer the US pilot's CBA. This is fact. How can the courts claim DFR from a NOW super-ceded CBA?
The 3 merger committees are west/east/AA pilots. How does an injunction play against an autonomous committee now represented by the APA? Not USAPA.
Could this lead to another declaratory judgement this time on behalf of the APA? The mandate is ambiguous at best.

Just "spit-ballin'", BUT the appeal was for the DFR case in Judge Silver's court WHEN USAPA was the agent. 9th will hand down to Silver to REVERSE the ruling, AND consider court costs and possibly DAMAGES. How much is that? Further, Judge Conrad is considering what to do with USAPA & it's funds.

Oh, BTW....Not showing up for an arbitration that you agree to is NOT A PLAN. It's more like a "Hail Mary". You should read the last two days transcripts from the SLI panel.

I don't think damages are going to be considered with the 9th. They just mentioned attorney fees which should be in the range of 100k. However the separate litigation in NC with Judge Conrad has the potential to award damages. It also names 14 USAPA officers personally. Hopefully those reps will be personally responsible for the millions of dues money that was misspent. It would be poetic justice if the USAPA braintrust was bankrupted for their actions of the last 8 years...

But the case has been remanded to Judge Silver to "consider the West Pilots' claim for attorneys' fees". It does not specifically bar Judge Silver from looking at ALL expenditures for all litigation for DFR. It does not specifically bar Judge Silver from considering damages related to the now ripe DFR.

Further, Judge Conrad is crafting his order for the disgorgement of dues.

We'll see.
