"Reduced Thrust" cause for Comair crash?

Most FOM's require runway lights to be operational... at that time in the morning that takeoff would have required consultation with company before initiating with partial lights being out. It is my understanding that the lights were NOT notam'd out.... another reason to check and highlight all applicable notams on your release in the preflight.
 
My question

Was runway 26 notamed closed? It is now

If runway 26 was closed, I guess they didn't deam it necessary to pull out the big yellow X's to put on it.

I however noticed after the accident these Yellow X's(with bright lights on them) were brought out to show that the runway was closed.

I mean if they have these X's why aren't they brought out everytime a runway is closed(especially when heavy construction is being done and airport signage is not 100%, not just when they feel like it). I am sure a lawyer could prove some sort of carelessness on the airport management since they had the markings and chose not to use them.

I have noticed at some airports the same thing, the runway will be notamed closed and yet there is no visual marking to indicate it is.
