To each Flight Options pilot:

Once a year the local of the union you elected to represent you – Local 1108 – is “recognized” by the calendar we all observe. 1108, of course, corresponds to November 8, and in fact, we have received numerous reports that there is a union-related agenda for November 8. That agenda, however, is one we believe is not in the best interest of our owners, our Company, or our pilots as a group or as individuals. More specifically, we have received reports from a number of our pilots that some of their peers are advocating a pilot sickout on November 8 to send the Company a message.

First, there’s the “legal” reason this is a bad idea. At this point in the negotiations process, the Railway Labor Act prohibits self-help by either the Company, the Union or the pilots, and thus engaging in the advocated sickout would be illegal. In fact, even advocating a work slowdown or concerted interference with the Company’s operations, such as a sickout, a write-up campaign or a ban on overtime, is illegal. This is a fact even the union acknowledged yesterday when it wrote to you. . ."The Union does not advocate, support or encourage pilots to engage in a sick out on
any day, including November 8, 2007. "


In addition, you should know that any pilot who engages in an illegal sickout or job action is subject to Company discipline, up to and including termination. Fortunately, we believe a large majority of our pilots would neither engage in an illegal slowdown nor advocate that others do so. Unfortunately, a small number of pilots acting illegally can negatively impact operations. For that reason, I want to be sure each of you has accurate information about the potential repercussions of engaging in illegal actions.

In addition to the current rumors relating to November 8, we have heard from some of our pilots about disruptive actions other pilots are either engaging in or advocating in order to “send the Company a message.” What’s the message? The Company has not refused to consider Union proposals on wages, vacations, health and welfare benefits, sick time, job protections, schedules, or any other subject. In fact, neither party has even made a proposal on wages, vacations, benefits, 401(k) or even sick time. The parties have spent most of the table time in recent sessions discussing, at the Union’s request, Crew Bases. The Union initially had proposed a completely criteria based system for identifying crew bases for all current pilots as well as future new hires. The Company countered with a proposal that would grandfather all of our current pilots, allowing them to stay in their domiciles regardless of whether it meets the criteria, and to retain their current rights to move between existing domiciles. In October, the Company agreed to the Union’s overall concept of a criteria based system for new pilots (details are yet to be hammered out) and the Union agreed to the Company’s proposal that our current pilots will be grandfathered. The negotiation process requires give and take from both sides.

So I come back to the question of what message is meant to be sent by causing unnecessary interruptions to your Company’s operations? We believe the message appropriate for November 8 (and every day) is that we are working together – every employee, including every pilot, and the Company – to establish Flight Options as the fractional operator that provides the best travel experience in the industry.

HOW TO PRE-FLIGHT A BEECHJET


1. Power lever gators (the rubber that keeps stuff from falling into the pedestal) needs to be intact not worn downing item
2. Bonding cables under the spoilerons
3. Top of brake calipers for leaks
4. Plastic conduits for wires for the main gear for fraying and damage
5. Hydraulic lines that go into the pressure switches below the reservoir (mx might try to get you to leave a rag in there for the next flight to check for drips. this is unsafe and illegal) don't even reach in to wipe them (I can't reach them anyway and I have slender long arms)
6. Missing rings/washers on the air stairs, or safety wire, safety wire is not per the BJ MX Manual
7. Nose wheel steering pin for a frayed cable (hazard as it might cut your fingers)(puncture wounds by sharp metal are especially prone to infection)
8. Pitot tubes for worn coating
9. Elevator horn coating (check with control lock installed for more thorough viewing)
10. Door seal channel for damage from door pins
11. Move all pax seats for free movement and locking (check for shoulder harness placards, including the lav seat)
12. All placards (exterior and interior) installed and readable
13. Michelins are installed instead of Goodyear’s, check sidewalls for wear as they are slightly wider and often rub while spinning down in the wells shortly after gear retraction
14. Seat belt extender placards for compatibility with seat belt systems with shoulder harnesses
15. O2 mask microphone function
16. Accumulator window too hazed to see through
17. Broken safety wire on emer gear/door/brake handle
18. Burned out fuel/hyd shutoff valve lights
19. Takeoff pitch trim horn doesn't sound if trim is SLIGHTLY out of the green
20. Takeoff pitch trim horn does sound if trim is BARELY within green.
21. Aileron trims run at different speeds.
22. One aileron trim hesitates partway through full range
23. O2 mask smoke clearing device broken
24. O2 mask weak pressure for inflating halo
25. O2 mask does not stay in cradle.
26. Smoke goggles too scratched/dirty to see safely.
27. Smoke goggles cover(s) missing/damaged.
28. Check for slippage on the engine inlet screws
29. Static and pitot drains are closed
30. Fire extinguisher properly charged
31. Cockpit trim indicator agrees w/ trim position marking on vertical stab
32. Cracked static wicks can be hard to spot without a gentle tug
33. Non-LED rear nav lights have a short lifespan
34. Drain holes under horizontal stab are clear
35. bonding cables under the spoilerons
36. Allowed, two degree's of roll per second when selecting flaps 10
37. Missing LED's on the clocks (No IFR)
38. Check the knife valve on the crapper. It is MEL-able, but a real live mechanic must come out and disconnect the electrical
39. Missing screws around the access panels ... found one plane missing 28!!!
40. Feed back from the hand held mikes. It’s a no no
41. Foil coated Fire retardant blankets in the main landing gear wells. Torn, punctured or missing the foil coating? This is a downing item according to QA. Not MDL’able
42. Engage the autopilot prior to doing the stall test. When the stick shaker comes on, it MUST also disconnect the autopilot.
43. Run your elevator trim full down and full up. If the needle pass the RED limit marks ... broke
44. On battery power only, run your rudder trim from full right to left or visa versa. The rudder must have full travel in less than 64 seconds per the mx manual
45. When selecting flaps 30, be sure they indicate 30, not 29 not 31 ... can you tell me what REF is for a flaps 29 or 31 approach
46. Big Dents under the door from stair malfunction. Must be measured with a caliper, That area is pressurized
47. Nose strut bottoming or bouncing on taxi, nose strut to low
48. Main door handle. If it lifts up without pressing the red button your done
49. Cabin door closed, the "Red" markings for the door pins must be "Completely Covered". This is listed in the AFM
50. All of this because, SAFETY, SERVICE, AND PROFITABILITY

this makes me fatigued and stressed just reading it. How could I possibly go out and fly safe after these workplace threats.

Huddle your co-hearts and lose your "airline mentality". Your pilots deal with the owners in this market 99% of the time. If pilots are not happy guess who else isnt.

I"ll give you a hint: they pay your freggin bills fool:bawling:

Reverse Psychology by FLOPS Management

Then, when no such event actually occurs, Management can claim Victory in that they intimidated said pilots, and try to make themselves look good in front of their new Masters (H.I.G.)

Its so nice to see FLOPS Management now engaging in these types of misdirection tactics. It means they are actually concerned about their own jobs, and now feel the need to "Fabricate" Victories over issues that never existed, so they can make themselves look like heros.

This is a GREAT SIGN my Brothers. It means that management is truly worried about keeping their own jobs.

Freedom is spot on with his analysis. I'd heard absolutely NOTHING about a sick-out or anything like this until BT sent out the e-mail. I read it, re-read it, and thought to myself "huh?"

Pity the poor pilot that is legitimately sick on 11/08. He’ll probably fly anyway, out of fear for his job. Maybe the other pilot or the pax will notice that he’s sick and refuse to fly with him.

Also, I’m suspicious of this whole conspiracy theory based on rumors. Why is management the only one hearing rumors? None of the stewards or P2P guys has heard anything about it.

Either management is playing games or Bob was duped.

I stay very informed on what is going on with our situation, but have to admit I didn't hear about this until Bob T sent out his e-mail. After spending hours at the FBO in TEB broken:rolleyes: nobody has ever said or hinted to anything that he described I think it is all made up.

I am now feeling pressure to fly from our management if I am sick, which I WILL NOT DO!

I will insted contact the FAA and send them a copy of this email to let them know that my job is being theatened if I am sick and don't fly on 11/08 or any other day of the year. I will not be forced or threatened by Flight Options management to break FAR's,and Sop's
 
I also never heard any such rumor. I am very in touch, and would have heard about it. It was fabricated by management to try to discredit the union. Funny thing, the union members are the only ones who have acted 100% of the time with pure, unblemished integrity, yet the managers are the ones who are caught time and time again in lies and deception. It even appears this time, as I would expect, that the first mention of something shady comes from where? The mouths of management. No one from the union has EVER suggested we do something illegal. Just playing by the book is plenty to make this management team unable to make ends meet. They are the ones padding their pockets off of my families misfortune, while we strive to cut costs at home at the expense of comfort....keeping the heat turned off....recycling clothes...etc. etc. You know those bums aren't having to worry about anything in their big fat homes, driving their Mercedes to work off of our backs.
 
The union has made a public response to this allegation, I have copied it below without personal comment.



On October 12, 2007, Shirley Kaufman, Vice President, Human Resources sent a letter to Jonathan C. Wentz, Outside Counsel for International Brotherhood of Teamsters Local 1108. In her letter, Ms. Kaufman claimed Flight Options was in possession of communications distributed by Local 1108, communications attributed to Local 1108, and communications distributed by persons claiming to be Flight Options line pilots advocating, supporting or encouraging an unlawful job action. The letter also claimed that management had received reports from line pilots alleging that they are being pressured by individuals in the Union’s leadership to file false reports about management personnel and the safety of Flight Options’ aircraft.

Mr. Wentz responded to Ms. Kaufman’s letter the same day. He requested that management provide the Union with all of the information in the Company’s possession relevant to the allegations in her letter. On October 19, 2007, Ms. Kaufman, Robert Tyler, Vice President, Flight Operations, and Marc Espisito, Outside Counsel for Flight Options, met with Mr. Wentz and other representatives of the Union to discuss the allegations contained in Ms. Kaufman’s letter.

Management presented your Union representatives with copies of several stickers, including stickers referring to a “Withdraw of Enthusiasm (W.O.E)” and “Crews Responding to Excessive Economic Pressure (C.R.E.E.P.)” The stickers contained the website address of Local 1108 and other markings related to the Union and were apparently mailed to the Company anonymously on customer satisfaction survey cards. Mr. Wentz informed management that the stickers were not produced or distributed by Local 1108. Management did not provide any evidence to the contrary.

During the meeting, management also said that individual managers had received calls from individual pilots claiming that a sick out is planned for November 8, 2007. In addition, management said that individuals have complained to the Company about harassment from union representatives in connection with maintenance write-ups. Finally, management said persons claiming to be Flight Options pilots have engaged in similar conduct on public internet message boards.

The Union asked management for more specific information so that it could conduct its own investigation, including the names of the pilots who had called management, the names of the managers who have spoken to them and all union representatives who allegedly engaged in misconduct. Management did not provide the Union with the requested information, thereby limiting the Union’s ability to conduct a thorough investigation of the Company’s allegations. Nonetheless, your Union’s position on the issues raised by management has always been clear and it bears repeating.

The Union has not engaged in any unlawful conduct. The Union does not advocate, support or encourage pilots to engage in a sick out on any day, including November 8, 2007. To the contrary, the Union has consistently counseled pilots as to their rights and obligations under the Railway Labor Act, including the obligation to refrain from applying economic pressure of any kind against the Company until and unless the Union is released from mediation by the National Mediation Board and the statutory dispute resolution mechanism is exhausted. Moreover, no person, including line pilots or managers, is authorized to use the website address, name or logos of the Union for any purpose without permission.

Finally, the Union does not advocate, support or encourage pilots to file false reports about management personnel or the safety of Flight Options’ aircraft. To the contrary, when it comes to maintenance write-ups and the safety of aircraft, your Union has consistently fought for the right of pilots to exercise their own professional judgment under the FARs, without interference from anyone, including management. The Union’s message has never wavered: do nothing illegal for or against the Company. Any statements, in any form, inconsistent with this official communication made by persons claiming to speak for the Union, whether they are line pilots or managers claiming to be line pilots or union representatives, are hereby disclaimed.

Your Union remains focused on the goal of securing a good contract for Flight Options’ pilots and their families. Before we secure a contract, there will be more rumors and misinformation spread by individuals with their own agendas. It is an unfortunate part of the process. Don’t get distracted from the mission. Keep your eyes focused on the goal of reaching a contract, support the Union 100 percent, get involved in Union activities, encourage your co-workers to do the same, and we will reach our goal that much faster.

Are you furking serious, Bob? What do you do for Options again? I'll tell you what... start treating the pilots right and you won't have any "messages" to worry about.

Gee thanks for so generously "not refusing" to "consider" some of these things for us. Lest we forget the grand history of Options repeatedly screwing the crews? You had a chance to change all this way before the Union was ever voted in.....but you didn't do sh1t. You're going to have to do a little more than "consider". We know dam well the only way we'll get what we deserve is by fighting.

Well, that's very nice. Wait a minute... didn't the union get denied extra bargaining sessions? What was the reason for that again? And, if I recall correctly, the union offered to negotiate those things first but the company denied that too saying "we need to negotiate the small stuff first so we know how much to offer when the big items come around."

GET THE CONTRACT DONE and you're little world over there on Curtiss-Wright Pkwy will be a much better place.
 
I'm definitely in the loop with the Union initiatives and can honestly say that the first time I heard of this was from Bob? Maybe Bob is suggesting a sick out??

I don't know about NJ, but I am convinced that the whole idea was dreamt up by Ford and Harrison to discredit the union. It is very telling in my opinion, that the first mention of something shady comes to my ears from Bob Tyler and NOT from the union or anyone associated with it. The ONLY message I get from the IBT is to do nothing illegal for OR against the company.

I don't remember NJ's management concocting such a bizarre message during the '04-05 timeframe.

I wonder if the union-hating B19 will be disappointed or happy if 11/08 (the day) comes and there's no massive sickout. Will he suggest that, somehow, the union wasn't strong enough to pull it off or will he, in some illogical manner, suggest that the pilots are breaking from their union masters and going to work?

FLOPS pilots: operate safely, legally, and with ice water in your veins.

What is the RLA?

The Railway Labor Act was drafted by labor and management and passed by Congress in 1936 without amendment. It differs from the National Labor Relations Act passed in 1926 in that it prevents labor groups the ability to go on strike at will. The intent is to ensure that interstate commerce is not affected due to labor unrest. The RLA outlines the processes in which we bargain.

Why do we bargain under it?

An operator that possesses an Air Carrier Certificate dictates that governance under the auspices of the RLA.
