Hello Newman - you really are a jerk. The Pocono Pilot of SkyWest.

The guy is screwed up for life. He will need a lot of treatment and long term care. I would guess he has millions of dollars in medical expenses. It could even be the attorney works for the medical providers.

If he had a choice, do you think he would rather have $10,000,000, or to somehow be able to turn back the clock and prevent this from happening?

I no longer work for SkyWest but thanks for playing. He would rather turn back the clock obviously. The problem is a legal system which lets a guy who screws up big time sue and probably win lots of money.
 
Uh huh. I'm sure you would just volunteer to work for the rest of your life and hand your check over to all of the families if you were in this situation. Yup. Uh huh. Suuuuure.

I love how you can actually put a price on a loved one. What a sad sad world we live in. Very sad.

If NO amount of money can replace them (which I agree with you on), then why do people go after all that money??? Things that make ya go hmmmmm.....

Simply, i would hope like hell not to survive anything like this. After watching all the family's, children and loved ones board the plane. Were i to kill off that many people, i would simply wish i could pay every penny they needed. 5 million is not enough. NO amount of money can replace lossing a kid, husband or wife. I hope all the family's get the money, they deserve it. They put their faith in that flight crew, that FAA tower, and that Airport lighting system. Together, they failed those passengers in the gravest way, and most of that blame should rest on the flight crew. Everything i read screams complacency, and look what happened.

What do you think of the AMR pilots wife in the LIT accident that sued the airport for incorrectly installed structures at the then end of the runway... she won.

What do I think of the wife? Well, just do give you some perspective, her own daughter disagreed with the lawsuit. How do I know that? Because we are friends.
 
The problem is jurors are 12 people too stupid to get out of jury duty so you can convince them of anything. It isn't about who is right or wrong it is about which lawyer can do the best tapdance. A reason why there should be a cap on these type lawsuits

Heads up!

Everyone ought to do this BEFORE something tragic like this happens. This will give many of those despicable ambulance chasing lawyers pause before going after you and your family.


Move all your assets into an offshore trust where you technically don't own them but you retain total and complete control over them.

Even if sued the plantiff will not be able to collect anything since the foreign governments are not obligated to obey a US court order.

It doesn't matter what the daughter thinks.. what matters is the rule of law.

A pilot that works for us is from africa.... the talk of lawsuits in america came up and he stated.... where I come from a person can't even sue. There is no due process, no ability to be heard.....
 
Reading this post has given me a sudden wave of nausea. I can't believe that I might have to sit 3 feet from some of you someday.

Newman: Get off your soapbox and stop whining about the system. This guy's screwed- end of story. Anything he does at this point is moot, including filing suit against the airport lighting manufacturer. Besides, all because you lost your "McDonalds made me fat" suit, doesn't mean you have to rag on the system.

Megadeth: Why are you posting on FI? Don't you have to pick up your trenchcoat from the dry cleaners and clean your guns? The words "bitter loner" come to mind.
 
You cannot file bankruptcy on this kind of lawsuit this one sticks for life.

sorry buckwheat, have to disagree with you. basically the ONLY thing a chapter 7 cant wipe away are taxes and other funds owed to the govt. everybody else gets nada.
like i said, they can all sue, but when its all over, he files a ch 7 and he walks away clean. besides, he worked for comair, how much money can the guy have anyway (especially after medical bills out the wazoo!)?

Where is ALPA's "protection" on this one? The way I see it, if my union is going to talk up "protection", I shouldn't have to worry about having to sue everyone in sight to save my arse.
More than 24 hours later and several posts from FI's most hardcore ALPA supporters...and still no answer to this question.
 
It's not what is right or wrong, legal or illegal. It's what a lawyer can convince a jury.

Yes you are correct!!! but with all the facts like other A/C taking off on the correct runway before they did and all the findings that the FED's got against them, I dont thing his law suit got a chance.

I cant freaking imaging what him, his family and everyone involve is going and will go through!!!
 
I thought one is immune from an individual lawsuit if you are on company time and the alleged action you are being sued for took place in the course of one's job.

Seriously see my earlier post. It might be too late for an offshore trust for this poor guy but it is NOT for the rest of you. ACT NOW and seriously look into that. Just trying to save someone's elses arse!
 
Oh no...you can be sued bigtime, and if your actions are determined to negligent or a causal factor you better start selling your assets off they will get you..even if you are dead your widow/widower will find themselves deep in poo

ALPA is not your personal attorney. ALPA is there to represent you in disciplinary cases, and to represent you in grievance proceedings when the company violates the contract. ALPA is not there to represent you in criminal proceedings or civil actions. For example, if Jim was able to still hold a medical and legally fly, then ALPA would be there to represent him if the company terminated him over this accident. However, ALPA is not there to represent him when someone sues him in civil court.
 
You guys disappoint me. Pilots used to be a brotherhood. Now it's a bunch of knowitall low-time geeks throwing rocks and having no idea what the target is.
You with your backpacks, iPods, fairy hairstyles and "too cool for my Captain" attitudes...that could have been YOU in the accident. It's easy to sit here with all the facts and hang a guy out to dry. None of you are human factors experts or accident investigators, but you all seem to know enough to give your worthless opinions as fact. But I'll bet if someone asked the pilots of that CMR plane about taking off on the wrong runway they'd say that it would never happen to them. Yet here you are doing the same thing.
Shame on all of you.

The problem is... the big mouths don't have all the facts, yet they feel they can offer up legal opinions...

Never happen to them... HA! This same event happened one year earlier at another CRJ airline... the difference? The wrong runway was long enough....

The smartest action to take is close ones mouth and listen and learn, but some people just.....can't....seem.....to ....do that....
