It wasn't a trial, it was oral arguments before three judges from the appeals court.
It may take months for a decision but it is very unlikely that Mesa will lose. There wasn't any new evidence introduced and the standard to overturn the lower court is high.
Sounds like DELTA SUCKS!
I am sure we will keep this one in litigation on some level for some time to come.
I would be very surprised to see Mesa fly for DAL ever again.

I think that DAL shot themselves on this one. Whitehurst singlehandedly destroyed their case. Lets see what the outcome is but I am not holding my breath.

The Big Sky/BOS deal was an attempt by Delta to fly overlapping routes with US Airways. The deal was signed when US Airways was making its hostile takeover bid of Delta. In case US Airways won its bid, and the merger made it as far as anti-trust rulings in the courts, Delta was going to be able to show that they and US Airways had too many overlapping routes, and that passengers would lose too many competitive options. Never mind that only US Airways had been doing most of those flights (via Colgan with 1900's) for years...You gotta remember this is the same Delta that went with Big Sky out of BOS.
Because JO offered to pay for the leases on the ACA Dojets (until DL was able to get rid of them in bankruptcy) and to whipsaw the other regionals in the DL portfolio.....
