Lawsuit filed against SWA....

KANSAS CITY, Kan. (AP) — A judge has set a trial date in a discrimination lawsuit filed against Southwest Airlines by two black passengers who were upset when a flight attendant recited a version of a rhyme with a racist history.

Grace Fuller, 48, and her sister Louis Sawyer, 46, were returning from Las Vegas two years ago when flight attendant Jennifer Cundiff, trying to get passengers to sit down, said over the intercom, "Eenie, meenie, minie, moe; pick a seat, we gotta go."

The sisters say the rhyme was directed at them and was a reference to its racist version that dates to before the civil rights era: "Eenie, meenie, minie, moe; catch a n----- by his toe."

"It was like I was too dumb to find a seat," Fuller said. Sawyer said fellow passengers snickered at the rhyme, which made her feel alienated.

The sisters are seeking unspecified compensatory and punitive damages.

U.S. District Judge Kathryn Vratil last week dismissed the sisters' claims of physical and emotional distress but set trial for March 4.

"The court agrees with plaintiffs that because of its history, the phrase `eenie, meenie, minie, moe' could reasonably be viewed as objectively racist and offensive," Vratil wrote. The second line of a modern version of the rhyme usually goes, "Catch a tiger by the toe."

Airline attorney John Cowden said there was no intent to discriminate against any passenger.

Cundiff, who is white and was 22 at the time of the incident, said she had never heard the offensive version of the rhyme. She said she learned the Southwest version from co-workers and used it as a funny way of getting passengers -- who are not assigned seats on Southwest -- to sit down.

Plaintiffs' attorney Scott Wissel said the sisters also want Southwest to stop using the rhyme and provide employee training to prevent such incidents.

Congratulations to Grace Fuller and her sister Louis Sawyer for passing along the dark version of that rhyme to an additional 2 or 3 generations of young Americans who otherwise would never have heard it. If people like this don't stop picking at scabs, we as a society will never get past the racial divide.

Sometimes I just don't even have words to react to idiotic actions such as this one. Sometimes I just want to freakin' scream.

I smell the stench of Jesse Jackson behind here somewhere.

It's a sad commentary that the once great civil rights movement has been corrupted by individuals like this. Anyone who is a minority should be ashamed by these individuals because they make everyone look bad when they use it to their advantage in something so petty.
Talk about looking for something to complain about.
 
Anybody can relate rascism to anything.

Take a simple game of pool.

Green table relates to the green earth.

Cue ball is the white man trying to supress all colors by sinking them into the 6 holes.

At the end of the game you have got to sink the prized Black ball.

Before I get flamed for plagerism, I got this analogy from a movie. (I forget which one)

In one of my speech classes in college, there was a fellow who gave a lecture on race relations and he used several gaming analogies like the one you presented. During Q&A after his speech, I asked him what he thought of bowling.
 
Yet another reason why we need a "loser pays" system in this country!! But who am I kidding... the F****ING politicians who make the laws are all lawyers. Would a thief cut off his own hand? :mad:

I'm an attorney but hey no offense taken... I feel like most of you do. Keep one small point in mind when you hear about these crazy verdicts, they were almost all heard by and decided by a jury of your peers. Yes, it is a sad statement on society, as a whole. Just make sure you do your part to hold the line on common sense and decent values.

KlingonLRDRVR -- If you are a trial lawyer or have every served on a jury then surely you realize these are rarely "juries of your peers." Depending upon the case and the desires of the lawyers who craft the jury selection, juries in these big award cases can often be made up of the Jerry Springer crowd with no steady livelihood who are anxious to "stick it to the man with the big bucks."
 
Wait till you see my story in the news. I am getting a lawyer to sue Nabisco for me. I am offended at the use of the word "CRACKER" on the fron of the saltine box. The companies that make " white bread " are next on my list.
 
I think the FA should counter-sue, she surely has to be offended and emabarassed from being labeled racist by the two ladies that were offended and emabarassed. Its a vicious cycle.....

Ok, I got it......

The Black ball is removed from the "pen" with the rest of the Black balls and is thrown down the lane into the White pins' world. His only two options are end up in the gutter or knock off a bunch of White pins.....no matter what, he ends up getting sent back up to the pen :eek:

Why is it OK to have a Black Miss America? Why is it OK to have BET (Black Entertainment Television) but it would be illegal to have WET (White Entertainment Television)???? Why is there Quotas in this day an age?? Not enough white basketball players- nobody complains - because the best athletes are on the court- and thats how it should be- period - The most qualified - - colored blind! - MAX
 
swa lawsuit

ok I usually just read but now I have to reply. I hope SWA loses this lawsuit and then to make up for it they raise the price of all their tickets to cover the cost of these blood suck ho's. Then lets see how many friends these b@#$*$^ have. P.s. On the way to the courthouse they will probably stop at McDonalds and spill coffee on themselves just in case the race card thing doesn't pan out.

Every frivolous lawsuit starts w/an idiot judge that fails to throw it out for lack of merit somewhere along the line.

I was born in '67 and never heard that version of the rhyme. But then, I don't listen to that rap b.s. where they use the n-word every six seconds so I'm sure there's planty I don't know.

Screw those money grubbin' ho's. I hope Southwest fights it and refuses to settle.

Southwest will win this one. It's ridiculous.

By the way, I'm all for "Loser-Pays" as well. That would definitely cut down on frivilous lawsuits.

The Judge dismissed two of the three allegations made by the Plaintiffs. If there is a basis for a factual dispute, which there probably is in this matter, then the Judge is supposed to let it go forward.

The danger of this case for Southwest's insurers is that damages are hugely speculative. There is nothing objective to measure the "punishment" Southwest might receive for their alleged racist statements.

John Cowden, the defense attorney is very skilled, but very pragmatic. As a former client, I would estimate he will recommend settlement rather than litigating the case as a matter of principle. I hope John & his clients will find their back bone, or at least their ethics and recommend taking this one to trial - and appeal if need be.

This is the problem with the current law system in our country. Trial lawyers know that it is cheaper for the big companies to settle rather than fight the legal / PR battle. I hope Southwest will use some of their profits to put an end to useless lawsuits like this. Hell, they are one of the few airlines right now that can afford to stand on principle.

If John and his clients had any ethics, this suit would not be happening in the first place.
 
Oops..got my sides mixed up. I thought he was the attorney for the two women filling that silly suit.

Other day I heard a song on the radio from a few years ago that even had that line in it. And I think it was even sung by a black person too
