Hm. I wonder how it was the FBI was able to take the flt 191 CVR recording as evidence against Clayton. Something disturbing about that. Is that legit?

- Corporate "discipline" and Federal investigations are two different animals.

Say bad things about your company and have them listened to after an incident can not result in discipline of a punitive nature from your company. ( At least not outwardly or officially anyway. )

Stop doing what you are trained to do and throw SOP out the window resulting in an incident, you can, and will, be held liable under Federal law as well as Company policy.

Well, that's the problem. I thought the CVR recording was supposed to be used for investigation purposes only. Incident/accident investigation, for the purpose of determining the cause and learn lessons, not federal prosecution.

I think the difference is that one is a criminal act and the other is just stupidity. here's what 121.359 (h) says:

(h) In the event of an accident or occurrence requiring immediate notification of the National Transportation Safety Board under Part 830 of its regulations, which results in the termination of the flight, the certificate holder shall keep the recorded information for at least 60 days or, if requested by the Administrator or the Board, for a longer period. Information obtained from the record is used to assist in determining the cause of accidents or occurrences in connection with investigations under Part 830. The Administrator does not use the record in any civil penalty or certificate action.

There is nothing to stop a certificate holder from using a CVR against it's employees, unless it is specifically prohibited in a CBA.
