ALPA Requests NMB Intervention in American Eagle Dispute
WASHINGTON, Aug. 19 /PRNewswire/ -- The union representing pilots at the American Eagle carriers has asked the National Mediation Board to rule that an unresolved dispute exists between the union and Eagle management, opening the door for a federal mediator to be assigned and some provisions of the current contract to be renegotiated. At issue is Eagle's decision to transfer 14 of its Embraer 145 aircraft to another American Airlines feeder carrier that operates separately from the American Eagle group.

"This is distinctly contrary to the expectations that Eagle pilots had when we agreed to the current contract back in 1997. The two most important factors in our decision to accept that agreement were job security and career growth. Transferring our aircraft out of Eagle is in direct contradiction to those expectations and the contract we signed," said Capt. Herb Mark, chairman of the Eagle pilots' Master Executive Council (MEC), a unit of the Air Line Pilots Association.

In a letter sent Aug. 19 to American Eagle management, Capt. Duane Woerth, president of ALPA, said "Rather than engage in brinksmanship over this issue, the Association takes its present action with the firm resolve of engaging the Carrier in discussions which result in an agreement satisfactory to the Carrier as well as Eagle pilots."

In calling for discussions mediated by the NMB, Woerth said that American Airlines management and the Allied Pilots Association, which represents American's pilots, should be included in the talks. The letter included the option of having Eagle and American pilots share in the jobs retained by not transferring the aircraft.

ALPA has asked the NMB to rule this the type of dispute that would require an NMB mediator to intervene, essentially opening up new negotiations of the existing collective bargaining agreement. Lesser disputes are handled through an arbitration procedure spelled out by the Railway Labor Act and usually do not entail renegotiation of an existing labor contract.

Anybody care to speculate on what will happen to Trans States if the transfer of jets is determined to be illegal?

Does anyone else see problem with this?? It's my understanding that Capt. Woerth didn't care to invite regional pilot input in the negotiations involving the USAir wholley-owned. Now that the regional pilots have requested mediation involving, what would amount to bolstering of a wholey-owned RJ presence, Woerth wants to invite (AA) mainline pilots, (who are not even a part of the union with which he's associated).

Maybe I'm way off base here, but I'm left with an uneasy feeling when Capt. Woerth wants to involve, (and effectively include in the negotiations), pilots from a completely different union. Can an ALPA representative meddle in the affairs of an unafilliated labor group? :confused:

Nasty is not the word

There are so many possibilities that could occur.
Who is to say what will occur.
But in the past, the mediator has sided for the company.
Being that compaines are saying they are dying due to 9/11 the mediator may go with them to help in keeping the flying going for the paying public.

Yes there is a contract, but sometimes the contract is not looked at since the paying public are more important.

But once again.....who's to say what will occur. I'm just glad that something is being done.

There was some recent press about Duane Woerth courting American pilots in an attempt to bring them over to ALPA. I wouldn't be surprised if he screwed the Eagle guys to get AA to switch over.

AA pilots are not currently interested in ALPA representation. Some should REREAD the press release. It is not ARBITRATION (where an outside person decides how to settle a dispute), but MEDIATION (where at the request of one (or both) parties in a conflict seek to meet and obtain a mutually beneficial solution). This was requested by the Eagle MEC no less !

There won't be any union changes or any J4J garbage.

I am not sure you got the gist of what 'ol DW was saying. Read this again.

If you think for ONE that ALPA would not sell Eagle up the river by supporting a J4J type initiative to romance the APA back into the ALPA fold, you are sadly mistaken.

I hate to be a conspiracy theorist, BUT, my guess is that Duane thinks that he can gain favor with the APA by supporting their involvement in any negotiations between AMR and Eagle.

Somewhere in there will be an offer to give those RJ jobs that are saved, by keeping the jets at Eagle, to furloughed AA pilots. A la J4J, AMR Style.

Of course, he and the APA will try to convince the Eaglets that somehow this a a great deal for them as ALPA/APA would then "explore the possibility of OneList".

In reality all Duane cares about is winning over the hearts and minds of the APA pilots in hopes they decide to come back into the ALPA fold. Under his leadership he would have bagged FedEx, repatriated Continental, and for his coup de grace, American. He would be sure to make the pages of FTL vol. 3.
