I need the forums help...here's the deal. I live in a community state and my ex-b!tch ran up about $45,000(in student loans and credit cards) that I am "legally"obligated thanks to our a$$hole state legislature. With my own (before marriage) student loans and these great profitable ratings I currently hold...there is no way I can live and pay these!!!! Should I declare bankruptcy would it effect my chances of getting a Job?

Thanks in advance...I am getting screwed hard and dry anyway I look at it. But I don't want to screw myself out of a job!!!
 
Work it out and save your marriage.

Adult decisions = Adult consequences. Marriage is a big thing. Can't blame the state government for your failed marriage.

Not being mean, just can't believe that 60% of them end up in divorce...doesn't ANYONE work things out anymore?

Tough call. Sorry to hear about the marriage. I would try to avoid bankruptcy - find a cheap lawyer or credit service.

Unless you consolidated both you and your wife's student loans under one loan, she is still responsible for them once you divorce. Her student loans are not "community property" as credit cards, property and car loans are.

What ever you do, find an attorney and get his/her advice.
 
I dunno if airlines look at your credit report or not. However I think if it was an issue you could explain what happened and all that. I dont think it should exclude you from a job as most major airlines havent exactly been the models for debt free living lately....

That is much easier said than done. Usually when it get's to this point even heavenly intervention will not save a marriage. I am pretty sure he has probably tried to work things out prior to posting the thread on this message board.

Yeah, I'm not trying to sound so cynical. I guess I'm pretty lucky...she's been with me since I was a nickel and dime flight instructor, and we used all of her life savings, etc to get here.

When your wife doesn't want you to be a pilot and is less than supportive of your desire to fly what do you do? For the record she filled and I tried to work things out but to no avail....
 
My simpathies good out to you. Divorce is like buying the farm. I never fought over money issues, we fought over the kids 12 years ago. Now they are 18 and 17. We never had student loans. On the plus side, you have a meal ticket, CFI. If her student loans are NOT communist property, then WOO HOO. Consult LEGAL counsel, you don't have the pain of childern. BTW, NEVER get divorced in Texas or Colorado. DAD"S GET F%&KED in both of these states. Bankruptcy last for 7 years on your report. Be careful on this one. Go teach your fantail off and donr sweat the small stuff. You can't take property to Heaven with you. Relax. Best wishes.

I don't know about all airlines but SkyWest does not do a credit check. I doubt any of the regionals do.

That's an outrage...after all the criminal behavior of liquidating pensions, furloughs, bleeding cash, pay cuts, elimination of heath care benefits...the lists goes on and on.

Here is a question...

What is your personal "bottom line"? When does flying an airplane for a living gets so bad you would change professions?
How low of a wage are you willing to accept? How much abuse are you willing to take form scheduling? How much time away from your family are you willing to spend? How much do you think your spouse is willing to take...living with a regional airline pilot?

It's a question that we all must face...because things may not get much better than they are now...

The whole community state thing is BS. That stuff is outdated and belongs in the 1950's back when it was customary for women to be the "housewife" and had no job skills. Nowadays, most women either have or have available to them the means of self support. Not only that, but in many cases they have Affirmative Action to boost them along. Also, if the woman decides to leave the man, HE gets hosed in many cases.
Divorce..ahh it didn't work out, too bad, see ya! If only it were that simple!

I am pretty sure Eagle doesn't do a Credit Check.

I would choose my wife over aviation any day. I don't know your situation any more than what's been posted but God bless.

My man...I have been looking for inspiration throughout this horrible experience and here it is...you have just changed my life from this day forward!!! Unfortuatly I meet with the b!tch tomorrow for the property settlement. I will get hosed and have to find away to get out of this the best way possible!!!For the forums information do not get divorced in Louisiana period!!! She's getting away with a master degree and increased earnings and I get to eat it. I have done this thing wrong from the start of the day she said "I'm not going to move around and follow you while you sit in that little airplane!!! I don't want you to be a pilot you can be a custodian at my dads church..." And no the custodian job does not make more money!!!! Thanks Guys and I'll update tomorrow on the BOHICA ritual!!!

Who needs it!?! It's not about airplanes.....it's about power. If she envisions you as less than her, she's in charge. If you're still interested, find a woman that likes you as you are whether you dig a ditch or fly an airplane.

Dunno 'bout other places, but in NC this statement is not true. When I experienced something similar during my last divorce, my attorney told me a few horror stories about wives intentionally running up debt to skew calculations during the Equitable Distribution hearing, student loans being added to the calcs, etc. In North Carolina, if your wife runs up a debt from the day you're married till the day of your legal seperation ... half of it is yours, no matter where it came from. :(

That's one of the funnier things I've read here in a while... "a month ago someone else got tired of the b*tches' sh*t". :D

I've never heard of a state where one marriage partner's STUDENT loans were EVER split between the two in divorce proceedings, unless, as someone else mentioned, you've consolidated them into a 2nd mortgage or other personal loan.

Before you go filing bankruptcy to get out of them, better ask your BR attorney, 'cause per some federal laws that were enacted in the late '90's, even in Bankruptcy Student loans are not dischargeable...

I asked a lot of these same questions after getting into a large amount of debt with a family business, and ended up having to file reorganization. Remember, it's the unsecured debt that is the big write-off item; if you want to keep houses and cars and you don't have much unsecured debt, bankruptcy isn't much help.

As far as credit checks? I've been told by the AIR, Inc people that most regionals don't run them, most majors do, and just about every reputable Corporate outfit ALWAYS does and BR can be a big negative, so be prepared to explain it and show that you had tried all available means of debt consolidation, debt/credit counseling, reduced repayment plans, EVERYTHING, and had NO alternative to maintain a place to live, a car to drive, and a way to put food on the table.

Sorry about your dilemma. but...

Please be sure to write her name clearly on bathroom walls nationwide so we can be sure not to caught up with the likes of her!!
 
Just got back from the property "mediation"!!! And very good news...The B!tch got HER student loans(30k) and the credit card (I told her we did not need) and the dept on the car. So basically things worked out okay. Like I told my parents (who have been there from day one and helped me above and beyond the call of parents) I did not win the war (neither of us did because no one wins in divorce) but I won the important BATTLES!!! I am left with my flight loans to pay and a credit card I did have access to use so on the whole I came out a lot better than I could have. The problem with her side was She kept bad records and I could prove all the amounts and smacked her around with the true number amounts. To get out of her student loans I used a "increased lifestyle change" (meaning she would have to pay me money each month) so she backed off the payment of student loans. So no bankruptcy in my future...again thanks to the Board for advice and support...and trust me once we sign the "final" document I will Work my ass off in the airplane and on the ramp(a great employee of a "regional"airline)to pay off my flight loans and move on...maybe I'll find a flight attendant to shack up with?
 
Good to hear, glad that a bad situation wasn't made worse.

One piece of advice: DON'T DIP YOUR PEN IN THE COMPANY INK!! Been there, done that, very bad juju... Find some OTHER company's F/A to shack up with! :D :D :D
