Anything you say can and will be held against you in the court of law. Even tone, meaning, pace at which you speak will be scrutinized. Honestly it was probably a good idea for them not to say anything. That's what this country and it's law system has come to.

For the safety of the passengers and crew, every evacuation checklist or memory action for evacuation includes "advise ATC".

The crew will have to offer an explanation as to why this was not done. Under the circumstances, there may be a reasonable explanation.

It is good news that there were no serious injuries or fatalities.

They were probably throwing their empties out the windows instead of declaring an emergency.

That's the atc recording. 1086 has already been cleared for landing when the recording begins.

I wonder why the crew couldnt notify tower that they slid off the runway.

They were said to be aware of the fuel tank breach.

Perhaps they decided to de-power the aircraft to avoid sparks.

Perhaps their comm antennas were gone.

CVR and FDR will tell the story.

That is a pretty good tail wind with snow etc...

Hard to be sure, but all five NY metro airports were showing winds that would have represented less than 5K tailwind component up to 15 minutes after the event. All airports reported rising wind velocity around 1630Z.

Disappointing to hear how long it took for it to sink in to the Tower Controller that he had an aircraft mishap in progress. Even with the weather conditions as poor as they were, he seemed shocked that an aircraft could have had an issue.

Hurts don't it. Now the shoe is on the other foot. A mistake was made and you are right. It could happen to anyone of us. Seems like when we make a mistake we are DANGEROUS and a bunch of WILD COWBOYS.
