Thanks for that. A staple is extremely unlikely whether we are represented by either union

Ask all the TWA pilots on the street about that. Ask all the Reno CA's that ended up in the right seat about that. Then ask Business Express pilots at Eagle and the Allegheny pilots now at Piedmont how it worked for them.

Keep in mind the only reason management will merge Colgan with someone else is to avoid a Bankruptcy filing for Colgan. What are your career expectations if your employer is facing liquidation? What is 'fair and equitable' in that situation? History is full of examples. When both pilot groups are represented by the same union fair and equitable gets defined completely differently than it does when they are not the same union.

Lawyers can drive trucks through all the applicable legal language. In the end it is the organization you belong to and its culture that will decide how it is done. Keep in mind all of Colgans potential merger partners are larger than Colgan and represented by ALPA. After the merger your property will be represented by ALPA. Unless you are looking for a fight to lose the Teamsters won't do you much good. If it is an internal ALPA 'family' matter it has a much better chance of being worked out amiably.

pretty sure the Business Express pilots were given date of hire with a few fences.
 
Teamsters is less of a union and more of a business at your expense. What have the teamsters brought to the table to help the industry as a whole- nothing. How much have they done in Washington to help the profession- nothing. It's ALPA that has lobbied for Crew Pass, the Stop Oil Speculation Bill, lobbied against the Open Skies agreement, etc. Teamsters is too busy cashing in on all they can to pay you attention. It's a thug union and a total joke.......when was any progress shared on any of their last contracts/negotiations? Haven't they been clowning around with Republic holdings for a while now? How's that going?

The TWA/AA and the Reno Air/AA mergers were all pre-Consolidated Appropriations Act, 2008. Reference post #38. ALL RLA mergers have to be in accordance with Allegheny-Mohawk Labor Protection Provisions 3 and 13. In essence, they have to be "fair and equitable" regardless of if they are two separate unions or even one union group with another non-union group. But you are correct that in the course of negotiations, theoretically, you can have a staple job be defined as "fair and equitable." Although I would imagine that the stapled group would probably take that to binding arbitration (well maybe not the non-union group who has management negotiating on their behalf) and it would be the arbitrator to decide if the staple job is "fair and equitable."

I am asking this question 100% seriously: Which (ALPA or Teamsters) is in Colgan's pilots interests? We need a union and need one BADLY. I think there are definitely pros/cons to each.

Discuss away.
