One more thing, I am curious why the brazilian (air force) controllers tried to assign an RVSM altitude to an airplane the were only getting a primary radar return from?? The ATC tapes have the BAF controllers calling the Legacy 7 times trying to assign FL360, while they are not getting a secondary (read transponder) radar return. Without a secondary return the Legacy would be unable to maintain RVSM, the crew of the Legacy did not know the BAF werer only getting a primary return..the BAF should have provided 2000 feet of separation to any aircraft they had no contact with.

BAF should have provided 2000 foot separation to aircraft they were in communication with. Why is there not a BIG question as to why the 737 was not informed about an aircraft that was at the same alt. as the the 737. THE BAF IS TRYING TO SCAPEGOAT A CREW, simple as that!!

that's fancy typing there...all you have to do is google brazil american extradition treaty. It should pop up. Do it for us now, because I already did and the only thing that popped up was a treaty for drug traffickers.

The us government can make a promise to return the pilots in the event of a trial...if they agree to it in writing, some would call that a treaty as well.

Extradition:

An extradition treaty between the United States and Brazil was signed on January 13, 1961 and implemented on February 11, 1965. The treaty allows both countries to request the return of individuals if the offense(s) committed are considered crimes by both countries. "Voluntary" extradition is not included in the extradition treaty.

All extradition cases are decided by the Supreme Court, with an average waiting period of one to two years. During this waiting period, the individual remains in the custody of the Federal Police and is entitled to receive consular visits.

Here's a copy of one of the two US/Brazil treaties available at a law firm's website:

Scroll down to "Article II" the list of crimes in the treaty.

In order for the two pilots to be extradited out of the US, they would have to be alleged to have committed one or more of those crimes. Anything else doesn't exist in this treaty.
