Uh, do they intent on actually returning to stand trial? The BBC article made no mention of their whereabouts, or whether they will actually return. Just quoted their lawyer.
So far as I know, Brazil and the US still don't have an extradition treaty. Is that correct? If it is, those two pilots should let the Brazilian Govt try them in abstentia and tell 'em to go to hell! Just don't ever plan on returning there. Friggin' Gov't has been pulling all the strings in the press to whip up anti-american sentiment among the population to distract everyone from the fact that it was the fault of ATC, which is run by Brazil's Air Force.
Can't allow egg on the face of such a Modern Air Force, no way. That could end up hurting someone high up in power if they start following the money and find out how much ATC money never got to ATC for modernization, but into some fat-cat's pocket.
Far easier to blame those "Evil American Pilots" who just had to be "Stunting" their new airplane full of passengers. What a sorry, corrupt bunch of a-holes running that country!
I don't care how gorgeous and easy the women down there are, I ain't gonna go there before they get some reforms in place.
