The arbitrator ruled that ALPA did not file in a timely manner and THAT is why he was not returning us to the 2001 contract.

Which according to our MEC Chairman is what makes the initial ruling so infuriating, in that the union really couldn't file any sooner because the fact were not present at the time, and of course the company was not forthcoming with said information in a timely manner. Holden should have taken this into account, but apparently didn't.

that was one of the considerations, but not the main driver in the decision. MEC is surely upset because they were a sleep at the wheel for 5 months which didn't help there case.

From the Arbitrators decision:

Over that entire five month period the Association was aware of the efforts the Company was undertaking to save itself, and at no time during that period did the Association inform the Company that it would be exposing itself to legal jeopardy in relying on LOA #8 in negotiating a long-term contract with another carrier.


Sure sounds like it was THE reason we did not get it back.

I find, on balance, that there exist some very compelling reasons for not returning the parties to the 2001 pilot agreement. Chief among these reasons are the following...


In sum and in view of all the considerations detailed above, I believe that the weight of judgment here dictates against returning the pilots to the 2001 agreement.
