This really is the crux of the problem though. Regardless of what the new 135 re-write looks like, someone out there will find a way to abuse it and this nightmare will eventually continue. It really is time for us to have that "one level of safety" and for the Feds to make it absolutely clear what the only correct interpretation of the reg. is. Doubt it'll happen in my lifetime though:smash: .
 
A Way Around the Rules

Yes I was being somewhat sarcastic, but there is reality in the thread. That is if you are a company that lives by the regs, you will have to hire more pilots to do the same work and either lower your pay or rasie your rates. You will still have to compete against the pirates in the business. They will find a way around the rules to lower their costs and put the companies who live by the rules out of business.

Our FSDO has been pretty clear that if you have the right to turn down a trip or not answer the phone, it counts as rest.
 
Don't know if anybody said it yet, but while the FARs might not say it, look to see what your ops specs say. That could be a limiting factor more than the FARs...

We have a guy here in town who, though it's been hard to catch him, most likely violates duty/rest regs. Just from knowing he showed up at 0700 for an 0730 departure and knowing he got back the same time you did the night before at 2300 and knowing he's booked through to at least 1900 that night. He's been tagged by the Feds a few times but wouldn't turn down a trip across town if it meant making a dime more than his competitors. Give's the legit operators a bad name...

I worked for a 135 operator for a situation almost like what pilotyip described. Of course one had the responsibility to be on call and answer the phone, but the company said, and the POI allowed, that if the pager bill was in your name, then they just happened to get ahold of you.

Never mind that the company supplied the pager, and you could not turn down the flight either. There are POIs who think try to interpret regs for themselves, like in that situation, rather than follow them as they are written.

Hopefully with new regs written, that do not have vague language, they will be less room for people to play around with the regs like that and undercut operators who do it right.
