I worked for a 135 operator for a situation almost like what pilotyip described. Of course one had the responsibility to be on call and answer the phone, but the company said, and the POI allowed, that if the pager bill was in your name, then they just happened to get ahold of you.
Never mind that the company supplied the pager, and you could not turn down the flight either. There are POIs who think try to interpret regs for themselves, like in that situation, rather than follow them as they are written.
Hopefully with new regs written, that do not have vague language, they will be less room for people to play around with the regs like that and undercut operators who do it right.
