LEXINGTON, Ky. (AP) - The co-pilot and sole survivor of a Comair jet that crashed and killed 49 people, leading to lawsuits against him and a federal finding that he was at least partly to blame, is determined to fly again.
James Polehinke, who suffered brain damage, the loss of his left leg and broken bones in the 2006 crash, understands he faces extremely long odds. But his passion for the skies has motivated him to get through rehabilitation.
"Jim has a love for flying. He has a love for life, a very strong determination to achieve every level of recovery he could possibly make," his attorney, Larry Moore, told The Associated Press on Wednesday.
Even if Polehinke were able to cross the medical hurdles, which Moore said is a long way off, it's uncertain what steps he would need to take to return his pilot's license to good standing. Moore said he believes Polehinke's license has expired.
Comair spokeswoman Kate Marx said Polehinke is on medical leave with the airline but declined to comment further on his status as a pilot. A call to the Federal Aviation Administration was not immediately returned.
David Royse, an attorney coordinating the legal efforts for the families suing Comair, declined to comment on Polehinke's ambitions to return to the cockpit. Comair is a subsidiary of Delta Air Lines.
Comair Flight 5191 crashed Aug. 27, 2006, shortly after taking off from the wrong runway -- a general aviation strip too short for a commercial jet.
The National Transportation Safety Board pinned most of the blame on the two pilots. Besides failing to notice they were headed down an unlit general aviation runway that was too short for commercial jets, the pilots violated rules banning non-essential chatter in the cockpit during takeoff procedures, the NTSB said.
Polehinke is among those being sued by family members of some of the crash victims. Moore is representing him in a separate lawsuit in which Polehinke is seeking to make sure his medical bills are completely paid. Polehinke has sued the airport, FAA and the makers of airport maps.
In a letter to U.S. District Court accompanying medical documents, Moore wrote that Polehinke's medical bills have already topped $4 million and that the amount paid in worker's compensation had topped $1 million. He said the bills were incomplete because future medical costs were unknown.
Moore said Polehinke underwent surgery on his right knee in January, and his long-term use of that leg remains uncertain. More surgery may be required.
Polehinke remains at home in Florida and is making good progress in rehab, Moore said. He attributes that progress, in part, to Polehinke's dream of flying again.
"That's what he's wanted to do with his life and still wants to do with his life," Moore said.

You pansy ass idiots. call it what it is...he f'ed up BIG time-and a bunch of people died. This is the type of descision making should not be tolerated--much less by professional pilots. What if your family was on this flight? I can care less if I offended him or anyone of you. This feel good, I will tip toe around anything that is percieved offensive is appauling. Call it what it is.

Does he have more than 250 hours? Wait, ASA will hire him. Hell, ASA will hire anyone with a heartbeat.

Nobody is 'tolerating' anything. We're trying to have a little compassion for someone that was the sole survivor of a crash that killed 49 people. He didn't get away with anything. He lost a leg and now has to somehow deal with the godawful idea that he played a part in this accident. What the ******************** is wrong with you?
 
The very reason this guy's medical bills are so high is because people like him are sue-happy.

BTW, I'm not a perfect pilot, but my mistakes never killed anyone or destroyed families.

This poor bastard is living the rest of his life knowing what he helped cause, and you have no compassion because your mistakes haven't killed anyone yet?? Wow. BTW he's not THE cause, he's part of the chain (part of which is also dead and leaves a family behind).

I somehow think you've never read Fate is the Hunter... Kharma's a bitch, and with an attitude like yours you're likely to be the next poor bastard to make that fatal mistake.
 
Yeah, but I ain't gonna try to go back flying whilst being sued and everything else. I'd get rehabbed, and leave the country ASAP.

Might be real good idea if you're ever in this guy's shoes.

I don't think some of you have any idea of the liability that you incur every time you push off the gate, or the underlying purpose of this suit.

You make a mistake, even an honest one that could happen to anyone, or you just have the bad luck to be an identifiable part of the accident chain, and you will be sued by one, or all, of the people sitting behind you.

Not just the company, the aircraft mfg, or whomever else the plaintiffs can think of will be sued, but you, personally, or your estate if you don't live, will be a defendant.

Your assets, future earnings, and any insurance payouts you receive will be targeted for settlement.

If you have the ultimate bad luck to make a mistake in a foreign country, you're likely to see a jail cell, as well.

Raising your hand and saying "my bad" isn't going to get you off the hook; and if you think that your company will help shield you in any way, well....good luck with that strategy.

The only recourse you may have is to mitigate the damage to yourself by proving that other parties share the blame.

Hence the suit against jepp and LEX.
 
although he's low on the turbine PIC time, this would be a doosey of a "tell me about a time" story for an interview at the majors....
