To answer a previous post, that was his appeal. Unless the Supreme Court decides to hear it (rare) or the 8th Circ. decides to re-hear its own case (also rare), then this one is over.

It was never found that he was in uniform. He claims to have worn his uniform shirt and pants without bars, etc. A waitress also claims that she did not recognize any pilots in the bar that night. The witness, a TWA pilot says differently. The Court even mentions that there is a dispute about what "in uniform" means. So the claim that he was in a bar drinking "in uniform" is a little exaggerated.

He got fired merely on the claim that he was in a bar "in uniform." It's interesting is that TSA's corporate policy afforded him the opportunity for "progressive discipline," which would have saved his job. The Union contract, however, provided that probationary pilots are not entitled to investigations, hearings, due process, etc.

Over all, if this guy, or any pilot regardless of race, was anywhere celebrating the 911 attack I think he should been fired. In fact, he should have his ticket pulled, too. IMHO the Court made the right decision for the wrong reason.

How about some other real terrorism in the last 20 or so years:


Sarin gas attack in the Tokyo subway systems, killed innocent Japanese people... non-Muslim terrorist group did it (it was a Japanese group with some agenda of its own).

Air India in 1985, a 747 blown over the Atlantic Ocean... Sikh terrorist bomb (Sikhs did it, not Muslims). Over 300+ people, dead.


How about the civilians killed with the IRA and their whole deal. That's terrorism, and non-Muslim.
