Does anyone know what a Mutual Arbitration Agreement is and what it has in it? Does that mean that you agree not to go to courts if there is a contract dispute, but instead you agree to solve the problem between you and your employer?

And does anyone know how common this is in employer/employee relationships?

It is an agreement to have any dispute argued before a certified arbitrator. It negates the need for attorney fees and court costs. Each side presents their case in confidence to the arbiter who, in turn, presents a list of demands to each party. The list is reviewed and itemized those areas of mutual agreement. The remainder is honed down over time and continued negotiation until both parties reach an agreement. The finding brought forth by arbitration is legally binding and enforceable.

The value is that each party is never in contact with the other. The issues that lead to arbitration are often fraught with bitter emotions that only serve to exacerbate the disagreement.
