Read the dissenting arguments by pilot neutral Bruscia on the award. He had a pretty good take on the 33% that got left out. When the list was awarded most East pilots were active again and placing 33% of east pilots behind ODELL is a windfall.

The East pilots were active again due to the merger,not to any doing by the old AAA. Windfall, I'll give that title to the top 517 of the List. The West was just happy that the AAA offer of LOS was not awarded, just like their draconic DOH list that fell on deaf ears in NAC talks with the company.
