GRIEVANCES

· ALPA MEC Grievances 01-10-01 (force majeure and minimum block hours) and 01-08-08 (duration of LOA 52) will be withdrawn with prejudice upon Date of Signing of the ALPA Restructuring Agreement by the President of ALPA. (Items provided to the pilot group in exchange for withdrawing the grievances include enhanced fragmentation protection, CARs protections, snap back protection in the event of change in control, Large Jet employment term at MidAtlantic Airways, and travel pass privileges for furloughed pilots and their families.)



PROTECTIONS, RETURNS, GOVERNANCE

· Bankruptcy protections for pilots stating that if the Company files for bankruptcy during 2002, the Company will not file for or support additional relief from the pilots’ working agreement, except temporary agreed items involving specific training and scheduling events.

Board to include ALPA voting Board member.
The size of the Board will be determined in accordance with the by-laws of the corporation.
Contingent Acquisition Rights: “Change in Control” added to definition of Acquisition Triggering Event; term extended to June 30, 2012.
Form a Labor Advisory Committee, consisting of a representative from each union and non-contract employees, to meet regularly with senior management.
· Terms for exchanging old options for a issuance of restricted stock for the first through fifth grants for those on the seniority list on July 1, 2002, (including currently furloughed pilots).

Sixth grant of options to be converted to restricted stock (1.84 million shares) awarded to current pilots.
· Pilot group would receive 17.5 million shares of restricted stock awarded to current pilots plus restricted stock from option program, total of 29 million shares (19.33 percent stake). In the event of bankruptcy, the Company agrees that pilots’ stake will continue to be equivalent of 19.33 percent.

· Commencing one month after the date of signing (13 months if in bankruptcy), the Company must make payments to defined benefit plan of at least 15% of monthly pilots’ payroll, on a cumulative basis. If the Company’s financial performance exceeds stated targets at the end of the year, pension contributions are to be increased as follows: 50% of the excess will be allocated to increased pension contribution for that year up to a maximum of 20 percent of the monthly pilot payroll including 15% requirement.

· Provision for pilots to receive additional cash payments if other employee groups together receive more than their allocated share of the returns.

BENEFITS
Establish national PPO medical benefits plan.
Three monthly premium/co-payment options: 80/20, 90/10, or 100 percent.
Four monthly premium categories: employee, employee and spouse, single employee and children, employee and family.
· Dental plan monthly premiums increased.
Improved dental plan for lifetime orthodontics benefit.
Maintain Pilot Qualified/Non-Qualified Defined Benefit Plans.
Implement Pilot 401(k) Plan enhancements.
Maintain Basic Life and AD&D.
Spouses will be eligible for benefits under the medical/dental plan, subject to a non-duplication method of coordination.
· Maintain pilot survivor benefit.
Increase maximum medical/dental care expense reimbursement of Flexible Spending Account Program maximum to $7,500.


SUPERVISORY / CHECK PILOTS
Covered pilots to receive an override of 9% (including seniors) except for line check instructors who will receive an override of 10% per hour when performing training.
Covered pilots paid based on what equipment they train on.
Covered pilots required to fly carryover trip during a rotation month with event accounting.
Covered pilots while rotating paid actual flight time or Reserve guarantee, whichever is greater with the override.
Instructor Pilots could conduct: landing currency, reestablishing landing currency (between 90 and 120 days), and CAT II and CAT III sign-offs.


INFORMATION SHARING
· The Company would provide timely information to ALPA on a broad range of issues such as: aircraft, shares, financials, pilot staffing, and code sharing.

OTHER CONTRACT ITEMS AGREED

· The Captain of every flight shall be made aware of all jump seat requests.

· Jumpseat riders accepted up to the number of empty seats on the aircraft. (Modeled after Hawaiian Jumpseat policy, including seating arrangements.) US Airways to make best efforts to implement by January 1, 2003.

· Continued pass privileges for furloughed pilots and their families.

· Permit use of TDY to assign flying to a pilot whose position has been eliminated in his domicile until he commences training for his new position up to the contractual TDY limit.

· Permit cancellation of a displaced pilot’s vacation to attend training if the pilot would become inactive with pay. Limit of less than 7 days and only with tailored intervention.

· Permit a pilot to be assigned an extra two-month training hold if awarded a new bid that also requires training.



CONTRACT ITEMS IN CASE OF BANKRUPTCY

From the date of filing of a bankruptcy petition concerning US Airways to the end of the twelfth month following such filing, temporary changes will be made in the ALPA Restructuring Agreement:



· Increase the hold for pilots in MDA or in Jets for Jobs as reflected in Attachment B.

· A Mainline pilot who accepts a Small Jet vacancy at an Express carrier must return to the same Mainline position that he occupied prior to his furlough. If the position does not exist at his former domicile, the pilot shall return to a domicile where such equipment is based.

· Reduce report for duty from 21 to 14 days.

· Extend training hold to 12 months.

· Reduce training notification to 7 days.

· Permit use of TDY up to 6 bid months in 12 months; no more than 4 assignments in 12 months.

· Permit training and/or movement of pilots up to 6 months before bid.

· Eliminate short block claims for September 2002 and October 2002.

· Short Call Reserves to cover out-of-base flying.

· Increase Covered Pilot training events from 16 to 18.



CONTRACT ITEMS TO BE DISCUSSED

ALPA will meet with management to discuss the following, or other issues, during the first six months of the ALPA Restructuring Agreement (12 months if in bankruptcy) with the understanding that the parties are not obligated to reach agreement on any of these items. The parties agree that productivity changes would not impact furloughs:

ALPA discussion issues:

Extend the FAE look-back period under the US Airways Pilots Retirement Income Plan to the earlier of 10 years or January 1, 1998. Discuss modifying rules for outside employment for pilots; allow outside flying within FAR limitations.
Cockpit jumpseat privileges for the alliance partner’s pilots with reciprocal arrangements for US Airways pilots (establish E-Links to pilot database to implement ASAP).
Add access to CATCREW/SABRE system on Company website. End the need for CompuServe by Dec. 31, 2002.
Ability to view jumpseat reservations on CATCREW.
Check Airmen – establish procedures for RIF.
Develop a ratio between the number of block hours to be flown by an equipment type in a base and the number of primary lines that need to be built. The ratio could also be in relation to the number of pilots on the plane in the base.
Develop a definition of “adequate coverage.”
Develop a definition for “reasonable effort” as it appears in the Agreement.
Section 11(E)1. To five calendar days of training in a row and then must have two days off, not five days of training in a calendar week.
Change the two-hour show no go to ensure that a pilot who commences a revenue pairing and subsequently returns to the same airport that he started the duty period from gets the full duty day pay. Two-hour show no go does not apply; a minimum day would be required.
Section 11(J)2: Confirm that a training “strike” is not required by a pilot to exercise his rights under this section.
Last Chance Agreements: Modify the AMPP to state that the Company will administer a standard “Last Chance” Agreement in all relevant cases.
Southwest commuter policy.
Lodging – move decision-making to Flight Operations Department.
Jumpseat reservations may only be made or changed by the jumpseat IVR system. The Jumpseat Committee shall monitor the jumpseat procedures/rules. Irregularities will be reported to Flight Operations.


Management discussion issues:



· Replace current bid system with a “Preferential” bid system.

· Modify the Reserve system.

· Eliminate individual trip sign-in and automate the AIL.

· Relax rescheduling restrictions.

· Modify rescheduling pay to scheduled or actual, for segments that operate.

· Create on-premise reserves.

· Combine B767D and B767I.

Use of medical/disabled pilots to conduct simulator training.
Establish training lines to reduce bought trips.
Permit pilot to move early to new bid to avoid inactive with pay status.
Permit use of TDY of up to contractual limits or extend training hold until next training class if a pilot is unable to report for initial training event and would become inactive with pay.

Multiple Jumpseaters????

Does anyone know if US Airways is now taking as many jumpseaters as they have empty seats and does this include non-US Airways Pilots (IE. Southwest Pilots)
 
We take as many jumpseaters as there are empty seats in the cabin, but beware. We parked 100 planes at Mojave & load factors are now through the roof and many flights are overbooked. Particularly transcon flights. Don't bank on us if you really need to be somewhere. I commute out of LAX and I'd say you have way less than a 50/50 chance of getting on in or out of here. I really wish the feds would sort things out so we can all ride in the cockpit again.
 
Try commuting out of LAS... At least you have 2 jumpeats on the bus.. I really hope the feds get off their a@@es and do something productive for us!
 
Unlimited Jumpseats...?

Are there any other majors besides US Airways and SWA that will take unlimited jumpseaters? I was just trying to get an idea of how hard the commute is going to be from CAE to OAK (where SWA is putting all the new hires).
 
America West & ATA take unlimited.

I take AW quite a bit and they are great to jumpseaters!
