Charge Dropped Vs. Pilot Accused of Threat

BUFFALO, N.Y. (AP) -- A United Airlines and National Guard pilot has been cleared of a charge that he lied on a security clearance application, in a case that began when a female acquaintance allegedly reported that he'd talked about crashing a plane into Wall Street.

Maj. Robert Feneziani, 44, of San Diego, was arrested last week by FBI agents and pleaded not guilty to the charge of making false statements on a Defense Department form.

Feneziani's attorney said the government agreed to drop the charge Wednesday after determining Feneziani's application had been accurate.

``What we wish is that they would have investigated before they arrested him,'' attorney Mark Mahoney said.

Feneziani was not charged in connection with the alleged threat to Wall Street. Mahoney said the pilot denied ever making such a statement.

``We cannot fathom the reason or motivation for including this career-stopping allegation in the (lying) charges to begin with,'' Mahoney said.

Federal prosecutors could not be reached after hours Wednesday to respond.

An FBI agent's affidavit attributed the claim to an acquaintance whose identity was kept secret. The affidavit said the woman called the FBI on Feb. 2 and ``recalled that in late 2003 the defendant threatened to crash his plane into Wall Street because he was frustrated that some people made easy money.''

The FBI then investigated the pilot and concluded he had lied on the Defense Department form when he said he had not been arrested or involved in civil court actions in the last seven years.

Feneziani had been detained in 2000 in San Diego, but not arrested, Mahoney said. And although his wife had filed a request for a restraining order, no order was entered and Feneziani was never served with papers or made aware of the filing.

United Airlines removed Feneziani from flying status following his arrest pending the outcome of the case.

``As soon as we are notified officially that charges have been dropped we will take the appropriate action,'' airline spokesman Jeff Green said late Wednesday.

Feneziani, through his attorney, declined to comment.

He is assigned to the New York Air National Guard's 107th Air Refueling Wing in Niagara Falls.

This reminds me of Richard Jewell (wrongly accused Atlanta Olympic bomber), I smell a lawsuit.
 
It would only seem appropriate that now the FBI should arrest this acquaintance whose identity was kept secret for filing false statements against this pilot.



They should also release the identity of this person to the public so that he may pursue civil action against her and so that she may endure the same embarrassment and ridicule. Why protect her identity considering she made a false claim???

At a previous airline, I was falsely accused of something by a flightie. It could've been a made for TV movie. The relationship was over and she pulled out all stops trying to destroy my life. She had started calling in sick to work a lot and was telling me she wanted to kill herself. I took her serious and called her parents to tell them they should be concerned about their unstable daughter. Meanwhile, while she was "sick", she had been non-revving around quite a bit. They caught her twice and were going to fire her. She told the supervisor that caught her that she was afraid to come to work because she was afraid of me because I had been threatening her. Her supervisor said that if I was threatening her, that she should file a restraining order against me. (I found this out later.) Next thing you know, I am getting a phone call from the Sherrif telling me he needed to serve me with the Order of Protection. He had already been into the airport looking for me, how embarrassing. I called an attorney and met him and the Sherrif the next morning. I was acuused of calling her 30 or so times and hanging up, stalking, harrassing, driving past her house and "Trying to destroy her life and get her fired." I was a commuter and did not even have a car at base. The court date was set for two weeks later. But in the mean time, I was GUILTY UNTIL PROVEN INNOCENT and had to avoid all contact with her. All that the company did at this time was keep her off of the equipment that I was flying. All that would've had to happen is for us to bump into each other anywhere and she could've called the cops and said I "threatened" her and I would've been hauled off. All this was happening while I was preparing for an interview at SWA, (after 9/11) talk about stress. I got my phone records together, affidavits of my whereabouts when I was supposedly stalking her and driving past her apartment and even a letter from one of her other supervisors stating that I had come in to ask them to give her a break. I told her supervisor she was under a lot of stess and I was trying to get her to talk to a counselor about her depression. Court date comes and I'm standing there in my best interview suit with my attorney and the crazy beyatch does not even show up, case dismissed. The attorney said I could sue her back, but his best advice was, "Stay the hell away from her, she's got a lot less to lose that you do."
I got hired by SWA, thank God, but the harrasment continued until the airline shut down six months later. She basically spent the next six months destroying my reputation and telling outragious lies about me to whomever would listen. My house was entered several times and my car was used. I had 2 cats, one mysteriousy died, the other one mysteriously got a broken leg. My friends, during all of this, the company did nothing.
Lesson learned...I have nothing to do with the Flighties that cannot be backed up by a witness. Protect your interests boys. Hell hath no fury like a woman scorned. It sucks that what can potentially be the best thing about flying pax (the flighties and overnights) is now almost off limits for me anymore. Sorry for the frightful story, but watch your back because your company will wash their hands of you until you work it out yourself.

Three important lessons proven by this:

Laws protect the guilty.

The FBI has a division for dolts.

A lot of women are nuts! Be careful guys.
 
The woman who accused him should be treated no differently than someone who calls in a false threat of hijacking, bomb, etc.
What did that 19 year old gal get recently for calling a false bomb threat? A year in prison?
This woman who accused the UAL pilot should get at least the same 'and' whatever civil penalties that are tied to slander, defamation of character, etc. Oh yeah, and her mug on CNN off and on for at least an entire afternoon!
 
Most women behave better than men, and the majority probably have a better moral compass.

However, when women go really bad, they often exceed the male capacity for evil.

Innocent until proven guilty is an American myth. Don't believe it? Just be unlucky enough to have some one accuse you of something then tell me how you feel after you've spent a small fortune to clear your self and still wind up with a "record". We have a legal system, not a justice system.

It is so simple at this point.

Step 1. GET A REALLY GOOD LAWYER, OR LAW FIRM.

Step 2 (and most important). SUE THE H.ELL OUT OF THAT C.UNT

Step 3. THEN SUE THE FEDERAL GOV'T.

Step 4. SUE UAL FOR BACKPAY AND EMBARRASSMENT.

Unfortunately it is not that easy. The woman likely does not have the resources to be worth suing and the government has passed law granting their officials immunity.

That is the reason it is so important that we carefully consider who we send to office. Here in Georgia we have elected a Republican Governor who has been down right radical in his appointments to the Bench and to replace Solicitors ( the Governor fills vacant positions until the next election cycle ).

All across this country we are seeing tort reform. Some of this reform is good, but generally, restricting a citizen's access to the Courts is bad.

I am probably more of a Republican than a Democrat, but the extreemly harsh positions being taken by Republican prosecutors, combined with an philosophy that everything should be illegal, is effecting many people's lives and there will be a backlash - probably with a bunch of very liberal Democrats being elected.
 
Yes, Flighties are FA's. And as far as suing my former psycho, it would've got me nothing. She had nothing to give and certainly did not give a hoot about her own reputation, just ruining mine. Her goal was to get me into the filth with her and it worked a few times, I came out looking like an a$$. You cannot argue nor fight logically with someone that is willing to constantly make up more lies. Like the saying goes, don't fight dirty with a pig, you'll get dirty and the pig will like it. And don't argue with an idiot, people listening won't know the difference. Aviation is a small world. My situation ended over two years ago and I still bump into people that bring it up when they see me. Do not underestimate the damage that crapping where you eat can do to your career. If I did not have a good relationship with the Chief Pilot at the time of my SWA interview, who knows what whould've happened. "Yea, he's a good guy, but he is under a temporary restraining order from one of our FA's." I learned more about our laws as they pertain to women's rights than I cared. I also learned that when you are down, lots of people will revel in the kicking. Why do you think the National Enquirer is such a big seller? There are lots of losers out there that feel better when someone with anything more than they have skins their knees or is suddenly accused of something. Ask a SWA pilot about the "Five Year Plan" of some of our FA's, or "Retro-Boobs," other examples of lofty goals of some of our most stellar citizens and fellow employees. Once again, sorry for the rant, I'm a tad jaded.
