That is exactly my point. It can be used at anytime anywhere. It all depends on the whim of ALPA! Anything the company gives us can be used as a basis for a lawsuit because ALPA deems it unfair. How fair is that?


ALPA doesn't like using its resources to file lawsuits on a 'whim'.

There has to be legitimate reason for them to. The ALPA OC at Skywest filed because they felt they Skywest Pilot Council is being given an unfair advantage.

Back in '99 when Skywest gave the pilots a pay raise, the ALPA OC at Skywest did not file suit.

So the pay raise Skywest gave the pilots wasn't an unfair advantage? Especially if they took it back????

I'm not following your logic.

What it all boils down to is ALPA (or the org committee) can file suit on whatever they deem "unfair". Again, back to my original point, anything the company gives us can be used against them in a lawsuit.
 
When are we getting rid of the Beech pilots. I hate them, they are holding the rest of the company down. There is a reason why they got the Beech and not the SAAB.(crappy sim interview)


Back the f*ck up!!!! The beech is the primary reason your sitting in the Saab in the first place you idiot!! That work-horse of an airplane got all that EAS money so you were given the opportunity to sit your fat arse on the slob! Don't ever forget that!
 
You are right. The company can "give" us anything. The problem is that anything they give us can be used by ALPA (or the organizing committee) to file a lawsuit charging the equivalent of "unfair labor practices". That is why they can't.

The OC can only file a lawsuit if they can provide reasonable evidence that the "give" from the company was only for the intent of harming the organizing effort. If the company can show that they had a need to "give" the pilot group something for true business reasons (stem the massive attrition for example), then the lawsuit wouldn't be successful. Your understanding of labor law leaves much to be desired.
