CAL has a few of these as well. Most are waay over 60 gummers from before the rule change. The difference is CAL ALPA has been trying without success to get them off of the seniority list for a while now.
The seniority section of the contract was one of the "no cost" items that was started on before formal section 6 openers over two years ago. A TA on the seniority section has been at an impasse over this issue for over two years now.
All of that is out the window now but know that its an even bigger problem on the CAL side.
CAL's entire simulator building is full of over 60 guys who where kept on the list before the age 65 rule change occurred.
CAL's EWR chief pilot was over 60 before Dec. 13, 2007. He was kept on the list and in the position of chief pilot contrary to the law. He illegally kept the position until the law caught up with his situation and became legal after the change.
CAL ALPA has done nothing about the over 60 pilots who aged out prior to the rule change but were kept on the CAL list illegally.
