Dear Fellow Pilots,*****
Today your MEC convened via conference call to consider the Transition and Process Agreement (T&PA) presented at the MEC meeting last week by Captain Jay Heppner, Chairman of the UAL-MEC Negotiating Committee. After careful consideration and deliberation your MEC ratified the agreement. The agreement does not require ratification by the membership as it does not constitute a major change in pay and working conditions and will now become an LOA.
The Transition and Process Agreement was the result of quadrilateral negotiations among the joint negotiating committees (JNCs) of UAL-ALPA, CAL-ALPA, UAL, and CAL, and is the preliminary step in the process of achieving a joint collective bargaining agreement (JCBA) that will determine the pay and working conditions for all pilots employed by the merged airline. As such, this Agreement accomplishes the following:
It specifies that the managements of Continental and United intend to complete the operational merger of the airlines no later than the first half of 2012.
It preserves the status quo, preventing Continental and United from shifting assets from one airline to another prior to the completion of the merger.
It provides furlough protection for all pilots on the property as of May 2nd, 2010, the date of the merger agreement.
It requires that, if either airline recalls its furloughed pilots and hires new pilots, that airline must offer jobs to the furloughed pilots of the other airline in seniority order.
It lays out a very rapid timeline for completion of the JCBA, with negotiations set to start on or about August 10th, 2010, with the intent of completion eight weeks later, on October 5th, 2010.
The overall success of the merger is very much contingent on the upcoming JCBA process. If management is serious about completing the merger in such short order, then its negotiators must be genuinely prepared to resolve our concerns. An eight-week time frame does not leave any time for posturing. In short, management must learn to say “yes”. The ALPA JNC is fully ready and prepared for the JCBA negotiations.*****
