Hey, hope everyone is doing well! Does anyone have any information regarding our 401K accounts? Specifically, when will the funds be released to us? I've talked to the 401K company, who said the IRS has frozen the account. Usually it takes 5-6 months to get released but when I called last week they amended that to "maybe longer". I've even tried calling the IRS and, literally, 3 hours later I couldn't find anyone who even knew who in the IRS is working on it. Anyone know of someone I call?!? Thanks!
 
Per the Department of Labor that regulates ERISA:

"Because each bankruptcy is unique, you should contact your pension plan administrator, your union representative or the bankruptcy trustee and request an explanation of the status of your pension plan."

I would start with the bankruptcy trustee since the administrator is not giving you details.

Good luck finding someone...my advice is to stay on top of it through communicating with other employees and waiting it out. ATA, the bankruptcy courts and our 401K provider held ours (C8) for aprox 7-8 months after company closure. Just keep your contact info and address up to date with the 401K provider. They'll send you a letter when the courts allow them to release the funds.

Who cares my friend, the DO-JET was still the best.

I heard there were a group of I-Air pilots sueing for seniority list integration with NWA, because that's where the certificate went.

Any truth to that?

Has anyone heard anything about the "unsecured creditor" claim? My legaleese sucks so if anyone can let me know what is happening in simple, common folk language I would appreciate it.

P.S.- NO, All IDE pilots were terminated, therefore they have no recall rights to anywhere except the unemployment office, that is IF the company filed the right paperwork to allow you to get unemployment benifits in a timely manner, which for many of us the company did not, so therefore..............oh never mind I just sound bitter-

For those interested in the 401K----I spoke with the IRS representative today. She said the funds should be released, hopefully in the next 2 weeks but if not then, no longer than 30 more days. Here's hoping...............
