This rule applies only to 121 operations. The FAA has not considered the appropriateness of the rule for operations other than those conducted under Part 121 because of insufficient data.

When they announced the rule change last fall, the FAA said that they were bypassing the normal comment procedures because they did not anticipate any negative comments. They also said that if there were negative comments, the would rescind the change. There were negative comments from the NTSB and the IBT so the FAA has rescinded the rule change.
