If you're aksing for an absolute, you can try 91.13 or 91.17(a) (3). The way that the courts in the US are ruling, they can prob nail you on one of these.
As far as I can tell, part 91 and 135 ops, a passenger briefing on smoking when it is allowed. No specific guidance, I guess it is up to you or your companies discretion.
I was just curious from a question I saw on Aviationinterviews.com. They said the answer was afte 10,000 feet you can smoke, but I can't find this anywhere.
