You're kidding right? Students do not have an expected right to privacy, this has been addressed a number of times by the courts.

Sorry, I misread your concern-I thought you were more upset about the invasion of privacy than possible outcome.

If he were to 'walk' it wouldn't be from a 4th amendment issue-students in general (it gets a little fuzzier in the college level) do not have privacy rights in the way you are thinking.
