Every RJ pilot should have to stand at foot of steps or jetway and anyone that wants to punch their faces in for any reason should be able to. Scumbags... all of them.

Hopefully, you take a swing. Hopefully, they hit back. But you won't, you're a coward who does not act on his beliefs.
 
Kidnapping?

I can understand how the crew had their hands tied by thier POS ops and management support teams.

Now why didn't the crew offer to open the main cabin door, have the stairs out then turn their backs. Who then walks off it's on them. It would have been real funny if the crew fatigued, packed up and got off themselves.

But I wonder if this falls under the form of kidnapping?

From the article: Kristy Nicholas, a spokeswoman for ExpressJet Airlines, said passengers couldn't go to the Rochester terminal to wait out the storms because they would have needed to redo their security screening and screeners had gone home.

The airport's manager, Steven Leqve, said that wasn't true. Leqve said passengers could have waited in a secure area until their plane was cleared to leave.
"This is not an airport issue. This is an airline issue," he said.
The Rochester airport took in another diverted flight, a Northwest plane from Phoenix, just before Flight 2816 landed. The more than 50 passengers on that plane were placed on a bus and made it to Minneapolis by 1:30 a.m. Leqve said the Delta manager in Rochester offered space on the bus to Continental, which declined.

Don't know the law that may apply well enough and how it may apply here. A person(s) held against their will long after the service they paid for didn't happen. Same person(s) also had the chance to deplane and may not have been informed about the secure area and/or the offer to ride on a bus. Not given the choice to make their own decision. The crime of unlawfully seizing and carrying away a person by force or Fraud, or seizing and detaining a person against his or her will with an intent to carry that person away at a later time.
The law of kidnapping is difficult to define with precision because it varies from jurisdiction to jurisdiction. Most state and federal kidnapping statutes define the term kidnapping vaguely, and courts fill in the details. Held against their will it sure sounds like. Sounds like grounds for kidnapping to me.

Regardless, something must be done to prevent this sort of negative experience from happening again.

I thought it was funny how CAL just tossed Express under the bus, backed up and ran them over again for good measure. Nice job CAL!!! I guess CAL has enough negative issues hitting the news this year that they are making it clear who's to blame.
 
I've often thought the same thing.

Now at those hours, you can reasonably sleep and try to manage through it, but at some point, the lav tank will be full, there will be no place to use the bathroom, get even basic things like water, or food, and it becomes a threat to your safety and well-being to remain trapped on board.

At what point, in such a goat rope, do you think it would be fair to take matters into your own hands? What if you have children with you? Now you're risking a DCS "reckless endangerment" claim if you take them with you out the Emergency Exit, whether it was really an endangerment or not (I'm pretty d*mn sure as a pilot, I can determine whether an action on board an aircraft is safe or not, but now you're risking custody of your children as well).

I have no problem going to the lockup by myself for 6-12 hours (I'll make bail and head home), plea bargaining it down to a misdemeanor (pretty sure a jury would agree that 12+ hours locked against your will in an plane, especially an RJ that doesn't require air stairs (just taxi over to a terminal exit and walk them up the stairs into the terminal for cripe's sake) isn't necessary and is certainly avoidable), and suing the crap out of the airline that did it to me.

But throw some kinks into it and now you're in a different situation. Whatever happened to that "Passenger Bill of Rights" that guarantees they can't do this to you? Every airline should have a deplaning contingency plan using air stars and getting close to the terminal to keep people from being held prisoner like this. Simply unacceptable.

A few corrections if I may:

- "Snorting crack" - Now we all know how bad that is for you. I'll stick with the shine my neighbor cooks up.

- "Wife" - Now we all know how bad that is for you. I'll stick with the shine my neighbor cooks up.

- "Work" - Not this year anyway.

Now, let me clarify and expand on my previously gin fueled sentiments.

The airline employee eats a sh!t sandwich almost everyday in the new environment with long duty days , delays, etc.

I am somewhat tired of hearing about a "Passenger Bill of Rights" blah,blah,blah.

Yes, I totally agree that there are some absolutely ridiculous cases ( ala NWA and JetBlue ) where people have been held hostage for way too many hours ( and apparently, for no good reason ) on the tarmac.

Guess what?

What about the Flight Crews? Are they not on those planes too? What are their rights? Oh, sit there quietly and endure the abuse because it's their J.O.B. ? Okay, I see that side of the argument.

Well guess what...Flight crews are people too and it is just as unpleasant, ( if not more so ) for them when these things happen.

Now, the folks in the back need to understand that just like it is our job and we choose to be there, it was their decision to purchase the ticket and travel on that day on that particular airline, and that they too have chosen to be there.

So, when it all goes to smack and we are locked up in that smelly metal tube together we need to treat each other with respect and make the best of the situation.

Idiot passengers, the media, and government all need to realize that sh!t happens everyday along these lines and flight crews DEAL with it day in and day out without incessant whining calling for "legislation".

Anyway, I'm off to the neighbors to see whose wife he is banging today and to stock up on my hooch.

You must have too Much time on your hands.
Not enough issues in your life to keep you busy?
But you are right.
Crack keeps you awake, and is expensive.
When you use it, you have more time to wonder about the Situation with the Exwife, the Exjob and the next EX something.
Stick to Hooch, (free if you are able) then just eat some Cheetos and watch a good porn, pass out and Boom you have kept your self out of jail.
It is the safe way.
Oh yea. The Capt. of said flight needs to be fired for dereliction of Duty. You have failed to take care Of your passengers.
 
YEP. I think they have.

Just look at the situation.
Also I think it sucks that the Captain had to be put in this situation, this really started with the higher ups in Management and their philosophy of doing things. It was just the Chain of events that put this Captain in this Spot.
The Captain could have done any number of things to make Management look good.
