DUI Question?

So if your arrested for DUI, and later the charges are reduced to Careless driving, but you still get ur drivers license taken away for awhile, how about then? Would you need the waiver? Or does Canada just look at the criminal end of it?

Dude, seriously, you're on FI looking for legal information and it looks like you are starting to believe what you are reading. Are you really willing to take the chance of being turned away when you go there because some guy on here told you it's OK. I didn't look at that form but there must be contact info on there somewhere. Call the Canucks and ask them. I believe that the law up there says any felony. Is careless driving a felony in Canada?

Seriously, IM NOT LOOKING FOR LEGAL ADVISE. A fellow employee is in this situation with the DUI/CARELESS driving. Just trying to help a brotha out. I should have know better than to post a Serious Q on FI. I just figured there might be someone that knows off hand.
 
No, because reckless is not a felony in Canada. A DUI is considered to be in Canada the same as a felony, so thats when you you are barred until you get rehab. By rehab, they mean handing over money to them with an application.
 
If it's more than 10 yrs old and nothing else on your record then you don't need it. If its 5-10 yrs. then you just give some money, less than 5 yrs. you need the waiver
